Brent Bennett, loosely quoting a recent  film on the eve before his departure to Afghanistan in April 2004.

Captain Brent L. Bennett
is from Fortuna, a small town in Northern California.  His family is about as American as you get.  He grew up hiking through the redwood forests, riding dirt bikes, and dating redneck girls.  He joined the US Army at 18, went through the US Army's Airborne School at Fort Benning, Georgia, and became a paratrooper in the U.S. Army 82nd Airborne Division, an elite Special Operations capable airborne division which is America's rapid deployment force.  With a legacy stretching back to WWII, the 82ND - "AA" is known as  the All-Americans with a rich history spanning every conflict in modern American history.  Bennett is an Airborne Forward Observer who specializes in Forward Air Control (FAC), and is a Forward Infantry Surveillance Team (FIST) operator.  His Special Operations cross-training in the U.S. Army Airborne includes combat medic, unit armorer, and Ranger tactics.  He served roughly six years in the military, had a short stint in civilian life, and, after one year of training and indoctrination, was selected to be  employed by the Counter-Terrorist Group U.S. ("Counterr Group" was formed in 1978) as a CT (counter-terrorism) operator in a direct action capacity against al-Qaida and related terrorist groups.  Although he was an NCO in the army, Bennett was brought onboard the Counter-Terrorist Group as an junior officer, and awarded the rank of Captain in the UFMF and CTG as the result of his actions against terror groups in Afghanistan.

During the 2001 war in Afghanistan, U.S. Army Special Forces A-Teams were able to inflict unprecedented damage on enemy forces as the result of CAS (Close-Air Support) missions where Green Beret and Air Force Combat Controllers used SOFLAM (Special Operations Forces Laser Markers) and GPS guided JDAM bombs to direct pinpoint strikes on the terrorists.  This method of warfare changed the face of the battlefield, and CAS, CCT, and FAC operators devastated enemy armor, bunkers, and troop emplacements as never before.  Another critical skill for CAS and FAC operators was directing the fire support missions of Special Operations C-130 Spectre Gunships either directly against the enemy, or, more importantly, for interdiction of superior enemy forces during a search and rescue mission, or the imminent overrun of a Special Forces position by far superior terrorist forces— often numbering in the thousands.

Bennett's FAC skills were important on the ground in Afghanistan when he arrived in April 2004, as were his infantry and CRW (Counter-Revolutionary Warfare) skills when working with the United Front Military Forces (Northern Alliance) and Afghan Ministry of Defense.  In the relatively short time Bennett spent working side-by-side with the Northern Alliance he came to admire Massoud and his Mujahadeen, and respect their courage and bravery; winning their hearts and minds, and most importantly, their trust.

Some Background Information about the SuperPatriots aka Task Force Saber/7:

Prisoner Of War status has become a hot issue in the War On Terror. The legal grounds to deny POW and Geneva Convention status to al-Qaida, Iraqi, and Taliban terrorists is simple-- they don't meet the requirements of Rule 4 of the Geneva Convention for Combatant Prisoners.  Few terrorists do.  To see these rules, follow this footnote: READ RULE 4.

Terrorists don't wear uniforms, have ID Cards, carry their weapons openly, wear unit patches (what would it say? AQ Killer Group with twin burning towers as a logo?), nor do they follow any of the other guidelines required by Rule 4, except that they might be subordinate to a commander (like bin Laden, Hekmatyar, Mullah Omar, etc).   But being subordinate to a madman does give rise to GC protections, you must follow all of the requirements of Rule 4.

The Geneva Convention Books about the laws and rules that certain bloggers say do not exist.

The press have called TASK FORCE SABER 7 personnel "mercenaries."  One headline from the NY Times (ala Jason Blair hype) is in some of our banners saying "Mercenaries in Afghan Case Get 8 to 10 years."  It is clear that these men are not, nor ever were mercenaries. See: GC Protocols Article 47.  The TF SABER 7 Geneva Convention Legal Brief/Letter clearly forecloses any argument to even consider they are or were "mercenaries." 

It is undisputable that all seven of the defendants had Geneva Convention POW status.  POW status is established by simply asserting the status upon capture or arrest in a conflict area.  At that point you have POW status.[1]  After that, it is up to the high contracting party (one of the countries that is a party to the conflict) to either accept or deny status.  However, status continues until such time as a Geneva Military Tribunal meets and either awards permanent status, or rejects status.  But, and this is an important but, from the moment of assertion, a person "in custody" or "confinement" has automatic status the moment they assert that status, either verbally or in writing.[2]   TASK FORCE SABER 7 personnel did that very quickly, and followed it up in writing.

Within 24 hours they asserted their Geneva Convention Status, within 30 days they asserted status in writing, and 60 days later they filed a complete legal grounds brief with the Central Information Bureaux in Switzerland, and copied the Red Cross- who are supposed to be the guardians of the Geneva Convention.[3]

My name is Brent Bennett; not Bill Bennett as the press keeps referring to me.  For the record, Master Sergeant Bill Bennett was killed in CQB (Close Quarter Battle) in Iraq on September 12, 2003 by Iraqi and al-Qaida terrorists, along with another great Special Forces hero, Master Sergeant  Kevin Morehead, both of the 5th Special Forces Group, and both who had fought in Northern Afghanistan in 2001.  The press didn't get their story right either.

My whole life I always viewed the press as a reliable and accurate source of information; a way to get the scoop on local and world news.  Then again, the weather channel is not always right, is it? 

I joined the Army in the first place to make a difference.  The government can give you the training and the tools to defeat terrorism, but they must also remove your leash, and ultimately it is the men and women on the front lines who will keep the terrorists from killing more American civilians.  Now, just as before, I feel the same way.  And we did make a difference, more than people will probably ever know.  However, that was before our political whirlwind and destruction by a vicious group of journalists who should have been working for Jerry Springer no the Associated Press.

When my teammates and I became news, I had an intense wake up call about the press.  The press wants you to think they are smart, informed, and honest.  In reality, they become nothing more than lemmings; when a story gets hot, or breaks, they abandon their individuality, and often their ethics.  They remain that way— simply rehashing someone else’s “scoop” or view, or, as in our case, false information, and remain that way long after the story ends.  In nine months I have seen only two articles that got even close to the right information about our case.  I would like to think that as the news coverage continues— for it seems to be never-ending— and as more reality and less fantasy becomes clear and available; that the stories would change and truth would finally prevail, but the lemmings have to save face so they continue the same screwed up story.  They feed off each others lies, innuendo, and most of all, rumors.  I know we are right, I know we were catching terrorists— I know we were doing the right thing, and I know we were saving lives, and saved lives.  Both American and Afghan.  In the words of TASK FORCE 180 at Bagram—before our “arrest”—we were “rolling them up.”  Of course, now we’re just renegade vigilantes.  Whatever.  All you need to know is that I would do it all over again hands down.  To do anything for my country and others who are too weak to defend themselves, this is my calling.  I am not a mercenary, I am a Patriot.  Who can tell you they have captured terrorists?  Saved the lives of two cabinet members, and stopped a terrorist attack on Americans before it happened?  Not too many huh?  Certainly not the FBI.

My “Afghan” imprisonment began with hearing the screams of tortured victims (mainly our  own guys) at the NDS prison in Kabul.  I could hear this from my little cell, that 6 prisoners slept in and stayed 24/7.  Yes we slept next to our al-Qaida enemies, except when the Taliban guards allowed you to go to the bathroom, or once every two or three weeks when I got to take a shower.  A shower that consisted of a rusted old bucket of cold water that I dipped a cup into and then poured the smelly water over my head, without soap I might add.  I might mention that the other Taliban prisoners could take a “shower” whenever they wanted to thanks to the Taliban prison guards.  We slept on cement floors with only a thin wool American Army blanket as bedding, and man, the way the walls of the prison smelled moldy and had scum that built up growing who knows what on it, and who knows when the last time it was cleaned.  We were isolated from each other to keep us from talking to anyone in our group (they did not want to let us talk in fear of what we might “plan” or do).  We were constantly yelled at and threatened; most of us were beaten and tortured repeatedly.  Since then I have lost seven teeth and one year later Major Ezmerai still has the electrical burns on his hands from torture, and both of Jack's shoulders still have torn rotator cuffs and one of his retinas is still messed up.  The closest comparable thing I have seen to our (NDS) prison conditions were in the movie Hell with Jean Claude VanDamme.  Midnight Express wasn’t that bad compared to what we endured, believe me.  This entire incident has opened my eyes to the extent that America has taken things for granted.  Americans actually think we are winning the War On Terror, or worse yet, have won it.  I have voiced this before, but in the atmosphere of NDS prison you have a long time to think, to soul-search, to ponder and reflect on all the things you wanted to say to someone that you didn’t get around to, or were a little too embarrassed to tell your feelings.  Those first three months were a living hell, and often I wonder how any of us survived.

Pulacharke—is like a dream, unlike NDS, “our bad acid trip.”  Our conditions have gone from being abused and tortured on a regular basis, sleeping on cement floors where sometimes there was no room to lay down, just sit against a terrorist, and where food was non-existent—we were given roughly two cups of rice and one piece of bread each day for three months; to virtually being treated like royalty.  But it hasn’t been without pain.  We lost a dear friend in December 2004 when an al-Qaida assassination attempt against us was prevented.  His name was Colonel Sherzaman.  He died in front of us fighting off Iraqis, Pakistanis and Arabs that were trying to kill us all, Jack mostly.  Apparently the terrorists actually thought their families might collect bin Laden’s reward on Jack.

But on the flip-side, we are welcomed by the many Afghans who fought and bled for Afghanistan, some of whom were with Jack in 2001, from all areas of Afghanistan.  Three more of our close friends were critically wounded in the battle, and four other soldiers died fighting the terrorists that day.  The Afghans see the real deal, and it shows by the way we are treated; the commanders, soldiers, and guards come up everyday to see how we are.  They ask if we need anything, and often visit just to say hello (these are the true Mujahadeen warriors–as much as I am a true American).  Yes, our conditions have improved immensely; and since then I have learned quite a bit of Dari– one of the languages spoken in Afghanistan, and the language of Commander Massoud’s Northern Alliance.

It was hard at NDS because almost no one knew English, and you had to try to speak to the terrorists whether you liked it or not.  It was like playing charades at first until I started learning more and more.  I am currently able to understand more than I can speak though.  I have hopes that one day Afghanistan will prosper.  They certainly deserve it after 26 years of war–can you imagine?  And no matter what you hear or read, the war isn’t over yet.

The Taliban and other terrorist groups are infiltrating the government again, quietly seizing power, secretly making deals, and treacherously planning their comeback and the destruction of American and the Northern Alliance.  It will be a great day when the Afghans can enjoy even the simplest of things that we take for granted in the U.S.–like electrical power, clean water, paved roads, and maybe one day it will even happen.  But right now, that day is a path yet un-cleared— the terrorists are still here, and with them, an underlying ambush for America.

My opinion stands, and you get this not from CNN or some self-proclaimed terror expert, but from boots on the ground, face to face with the enemy.  Some Americans after 9/11 forgot or don’t want to think about it.  You get spun through the mixes of life–(even night life)–and it can be easy to forget things, or put them out of your mind.

America is a great place, where you can lead a great life, and a comfortable life.  All that said, I ask you a question.  People, how can anyone forget about 9/11?  That was a wake up call, and some of you just pushed the snooze button.

I have talked, seen, and overheard many Americans talking about what they thought should be done, or what they wished they could do, or what they wanted our country to do.  I’ve seen our president in a speech that encouraged Americans to do what they could, enlisting every American as a soldier in the War on Terror.  Well, we did what every red-blooded American wanted to do, but few did.  And most of all, we did it well.  Everyone plays a role in this fight and mine involves catching terrorists before they strike, not after they stack our bodies up.

People are afraid to stick their neck out.  I stuck my head out and would do it again, in a heartbeat.  I believe the world would be a better place without the terrorists; and I believe in my heart that the rest of the world knows this in their heart.  And that America knows there is no other path.  The day may come when the terrorists win, and America is powerless to stop them, to protect our women, our children, and our families.  But it is not this day.  Not yet.

Saying and doing are critically different acts.  Wake up, drink some coffee if you need to, but realize that the terrorist threat is real.  I have received letters from many people; from family, from friends, and from total strangers that always relate the same thing to me— that the terrorists should be caught and it shouldn’t matter by whom or how.  People all over the world are supporting us.  With letters, and cards, and care packages.  Everyone that writes says the U.S. government should be giving us a medal… actually, three days before our arrest the government of Afghanistan was saying that we would receive medals from the president.

Three days later we were all in a dungeon in the basement of the Taliban’s old torture chamber.  I am still trying to figure out what happened.  Just before our “arrest” (it wasn’t really an arrest) I was prouder then I had ever been before in my life, or even in the 82ND Airborne Division at Fort Bragg.  I never cared about medals or money, or promotions, or personal gain, but I thought my country would at least say thank you.  That is not the case though; instead, some journalist heard a rumor and the “torture” word started flying around the mill and everyone looked the other way.  Damn, everyone believed the terrorists even though they were totally lying.  Wow, terrorists lie, now there’s a new concept.

Jack is true blue.  I would follow him into war and back again and I will stand ready to catch terrorists again, when Jack is ready.  That might be awhile due to the numerous people listed on "Jack’s Docket."  And there are quite a few.  But Jack will go after the terrorists again, it is in his blood.  He has been fighting terrorism for more than 25 years, before most people even knew what it meant, or why it was a threat to our country.  It is disgusting how much the press, the web, and “anonymous sources” like to smear Jack.  Why?  I like to think it’s because he and the rest of our group (and there’s a lot more of us than you think) here in Afghanistan are doing what a lot of people want to do but cannot, for one excuse or another.  Maybe for lack of courage.

I’m proud of our website.  I think it looks great, even unreal I thought when the first pages were sent to us, but it is also so very informational, and a behind the scenes look (kind of).  And, I’d like to thank those people “behind the scenes” for doing it.  Could thanks ever be enough?  And it is also a good tool for those who are law savvy and want to find out the real story in the case.  God Bless the U.S.A.

Inside the Secret File- the proof of POW Status

The Court's file contains complete, in fact, irrefutable evidence that the men of TASK FORCE SABER/7 are POWs under the Geneva Conventions and accompanying protocols. However, the men have not been allowed to see the file, or to use it in their defense.  The file that Judge Bakhtyari concealed from everyone, except journalists that paid him under the table, contained pictures of TF SABER/7 in military uniforms, operating with international military forces, in meetings with top government officials, pictures of their vehicles- with Ministry of Defence license plates,[4] Afghan military ID Cards, Afghan military visas, and authorization documents from Commander Massoud's top-level Northern Alliance commanders and Interim government Corps Commanders.

The Americans' US ID cards, US Passports, GC ID cards, and military authorization documents were immediately removed from evidence by the FBI and have never been seen again.  Why?  Because of Abu Ghraib.  The US government was still reeling from the Abu Ghraib pictures in July 2004, and were not about to be dragged into another abuse scandal.  The Americans and Afghans fighting the terrorists, were convicted by a Taliban Judge and a Taliban Prosecutor before the first day of trial ever began.  In fact, no witnesses ever testified against the defendants, nor was the defense allowed to call witnesses.[5]

All Afghan Combatants, including those that escaped and were not captured, were serving officers, commissioned ranks, in the United Front Military Forces (a.k.a. Northern Alliance) and the Afghan Ministry of Defence (previously the Northern Alliance.)

Most recently, on February 7th, 2005, the Afghan Court of Appeals, over great objections by BOTH governments (US & Karzai) cleared the men of ALL torture charges in a secret hearing where secret undercover video and audio evidence was played for the court.

The Geneva Convention is very clear on this issue.  Section III Article 72 specifically outlines and mandates the "Right of Defence"  § II, which states "Accused person shall, unless they freely waive such assistance, be aided by an interpreter, both during preliminary investigation and during the hearing in court.  They shall have the right at any time to object to the interpreter and to ask for his replacement.

Taliban Judge Abdul Baset Bakhtyari repeatedly violated this rule over and over, in full view of the press and even laughed about it on numerous occasions, yet not one journalist reported this-- a few journalists reported that sometimes "there were 'problems' with the translation."

Brent Bennett requested a lawyer AND a translator for his defense on at least seven occasions, and at least twice in writing.  He never received a translator.  The translator requirements, are also rules of international law, required in the trial of ANY foreign national, regardless of GC POW status.  The lawyer he received promptly informed him that she had been threatened by the FBI and NDS and would not represent him.

Bakhtyari's Court basically held a press conference, because the three terrorists that did "testify" were not sworn in, and according Bakhtyari, were for "public information purposes only."  If you get right down to it, the trial was a press conference, not a trial.  The Embassy, under threats of a civil war with the Northern Alliance, finally provided an interpreter for one half day.[6]

تمـــــــام افغان ها مبارزه نموده است حتــــــا آن اشخاص کـــــه دستگیر نشدند وگریختن تمــــام افسرهــــای برای خدمت هستند هرکدام آنها رتبه های عالی در نزد جبعه متحــــــد دارند که در وزارت دفاع قبلی وظیفه انجام میدادند.

اخیراً درفبـــــروری 7/2005 درمحکمه استنـــاف افغانستــان یـک اعتراض بزرگ که توسط هردوکشور بود امــــــــــریکا و افغانستان که دریـــــک دادرسی کــــوچک البته اسناد های ارایه گــردید که التبه تصویری وغیر تصویری بود که از تروستان بوده که بیان نموده است که هیچ کسی ایشــــان را شکنجه ننموده است.
 

قــــــانون جینواکانوینشن خیلی واضع گفته است دربخش سوم ودرماده 72  که البته دربــــاره حق دفاعی بوده است وگفته که هرمتهم حـــــق دارد کـــــــه از ترجمـــــــــانان ومنحیث معاون استفاده  درجریان تحقیقـــــــات دادرسی ها وجلسات محـــــکمه کمـــک بخواهد واین حق را هم دارند کـــــــه بخاطــــــر تبدیلی ترجمانان اعتراض به تبدیلی آن کنند.

عبدالباسط بختیاری طالب کـــه دایماً این قاعده هـارا مشکستاند وخـــلاف ازقانون مینمود وهیچ جـــــورنالیست بطـــور درست راپورنداده است لیــــکن بعضی گفته است که ایشان مشکل در ترجمـــانی دارند.

برای زرو اجازه نداده بودند که برای جــــــک ترجمانی کند در جــــــــریان جلسات محکمه در حقیقت زرو به جک گفت کــــه ترجمه مکمل غلط بوده وچیزی که سارنوال نگفته است اوتکراراً ازدلخود ترجمه نموده است وقتیکه زرو کوشید کــــــه ترجمه نماید وقتیکه درصدارت وامنیت ملــــــی برگشت نمودند ازطرف امینت ملی واف بی آی برای 30 روز زولانه گــــردیده است البته ازطــــــــرف امراله در24/7 میباشد.

نام من برینت بنییت میباشد، قسمیکه مطبوعات بیل بنییت یاد میکنند نمیباشد. از ثبت فلم ها دیده باشید که ماستر سیرجینت بیل بنییت در یک جنگ مشهور سی او بی در عراق در 12/2003 توسط بعضی عراقی ها وترورستان کشته شده است، البته همرای بعضی دیگر قهرمانان شپیشل فورس مانند ماستر سیرجینت کیوین مورهید، هردویشان در گروپ سپیشل فورس پنجم بودند، وهردویشان در شمال افغانستان در سال 2001 جنگیده بودند. همچنان مطبوعات قصه های درست واصلی آنها را نگرفتند.

درتمام زنده گیم، من همیشه نظر به مطبوعات کردم منحیث قابل اعتماد سرچشمه معلومات صیح قبول نمودم، ودایماً تلاش نمودم تا تازه ترین خبر های جهانی را بیگیرم وملاحظه نمایم، بعداً دوباره همیشه چینل هوایی همیشه درست نیست، آیا درست است؟

من در نظامی شامل شدم در اولین منطقه که یک تعغیر بیاید، دولت تمرین، اجناس بخاطر دفاع از ترورزم میدهد، مگر باید گردن بند های سگ راهم دور کنندوسرانجام آقایان وخانمان در نخست صفحه اخبار بوده که نشان میدهند ترورستان را دورنگاه میداشته باشند که امریکایی های ملکی را ازبین ببرند. حالا، من احساس میکنم که این یگا نه راه است. وما تعغیر آوردیم به زیادتر از این که مردم بفهمد. هرچی که باشد پیش ازاین که سیاست به گردباد تبدیل بگردد، خرابی توسط یک گروپ جورنالیست های چموش بوده، کسی که باید کارمیکرد جیری سپرینجر که شریک به مطبوعات بوده است.

وقتیکه من با همکارانم بک خبر جورشدیم، من سیری برخواستم که مطبوعات را صدا بزنم. مطبوعات میخواستند که شما بفهمید که آنها زیرک میباشند، که خبر بدهند، صادقانه . درحقیقت هیچ چیزنساخته اند وقتیکه یک قصه گمرتر میشود ویا میشکند. آنها درهمان راه استاد شده بخاطر که ازابتدا خبر را بطور غلط راپورداده است اگر تعغیر بدهند شرم آورخواهد برایشان بود. درمدت 9 ماه دواخبار راشنیدم که واقعات را درباره کیس ما نوشته کرده بودند. من میخواهم که اخبارات به همان شکل ادامه بدهند، ونباید ختم شود. وتمام واقعات ها هویدا بگردد درباره کیس ما. درحقیقت هرکدام آن جورنالیست ها ازیک دیگر دروغ ها را اظافه نموده است چرا که همه ایشان هم دست است. من میفهمم که ما درراه درست هستیم، من میفهمم که ما ترورستان را دستگیر کردیم، من میفهمم که بعد از خداوند(ج) ما جانهای خیلی اشخاص را حفاظت نمودیم افغانها وامریکایی ها ومیکنیم. قبل از دستگیر شدن ما قوای فعالیتی 180 در بگرام میگفتند که ما ترورستان را دستگیر میکنیم. البته حالا ما را بنام اشخاص بد یاد میکنند. هرچی که باشد ما خواهیم ادامه داد این گفته من است. که برای کشورخودما وبه دیگر کشور های ظعیف میباشد. من کسی نستم که بخاطر پول کمک میکنم من یک پتروتس هستم. کی گفته میتواند که ترورستان را دستگیر نموده است، حفاظت کنید جان های دوکابینه را واستاد نمودن ترورستان پیش از واقعه رخ بدهد. بیدون که کدام آح داشته باشد، واقعاً بیدون اف بی آی. دربندی خانه امنیت ملی هم اطاقان ما صداهای جزادادن را میشنویدن، ومن دریک اطاق خورد برای مدت 24 ساعت در هرهفته شش نفر میخوابند. ما در نزدیک وهمرای دشمنانما یعنی القاعده نشسته وخوابیده هستیم. حتا بیدون اجازه سربازان طالبان به تشناب رفته نمیتوانستیم، برای یک بار در سه هفته حمام اجازه بوده همرای بوشکه های کهنه وآب سرد بیدون صابون وشامپو حمام میکردیم. دیگر طالبان هروقت که میخواستند حمام میکردند فقط با یک تشکر چراکه تمام گارد مربوط طالبان بوده است. مایان در روی صمنت خوابیده همرای یک کمپل نازک نظامی امریکایی، دیوارهای کثیف وبویناک امنیت ملی، کی خواهد فهمید چی وقت برای بار آخیر پاک شده است. وما ازیک دیگر دور داشته شده بودیم که با یک دیگر سخن گپ زده نمیتوانیستیم، ایشان برای ما اجازه نمیدادند که با یک دیگر صحبت نمایم، وپلان های کاری خود را بسازیم. بالای ما چیغ وغالمغال میکردند وزیادتر وقت شکنجه میدادند. فقد مانند فلم جان کلود ویندم که در بندخانه روسیه بوده البته نام فلم نیمه شب میباشد. آن فلم آنقدر خراب نبوده که حالت ما خراب بوده است. امریکا فکر میکند که ما در مقابل ترورستان کامیاب شدیم وخرابتر ازهمه، من این را خیلی وقت پیش اعلان نموده بودیم مگر درامنیت ملی خیلی وقت کار دارد که فکر کنید، چیزی میخواهید که بگوید باید بالای آن کار کنید. واگر چی احساس میکنید شاید بشرمید، آن سه ماه اول زنده گی در دوزخ بوده ومن میترسم که کسی در آنجا کمک شود.

پلچرخی یک خواب است مانند امنیت ملی نیست. اوضای ما مانند قسم اول نبوده بلکه همرای ترورستان دراطاق نبوده است، در امنیت ملی دوگیلاس برنج ویک توته نان در مدت شش ماه همین قسم پیش میرفت. مگر این جا به تمام اشخاص بخصوص بما مانند پادشاه ها بوده است، مگر بیدون درد نبوده است چراکه دردسمبر دوست نزدیک خود را ازدست دادیم، البته بخاطر حفاظت مایان در مقابل ترورستان والقاعده بنام دگروال شیرزمان خان قوماندان ورزیده بوده که بخاطر ما جان خویش را فدا نموده است. اوشهید شد در مقابل عراقی ها، پاکستانی ها، عرب ها، بخاطر که این ترورستان اگر جک را ازبین ببرند، فامیل هایشان ازاوسامه بن لادین جایزه خواهد گرفت. مگردر دیگر دست ماخیلی خوش آمدید گفته شدیم ازطرف آن تعداد اشخاص که بخاطر آبادی این کشور جیگیده بودند، بعضی شان درسال2001 با جک بودند، ازتمام نقاط افغانستان، سه افسر دیگر که شجاعانه در مقابل این ترورستان جنگیده به شهادت رسیدند. قومندانان، افسران، سربازان روز به روز صحبت شان زیاد میشود ازما میپرسند که چی ضرورت داریم وبسیاری وقت بخاطر سلام تقدیم کردن مییایند. (این واقعت دارد که مجاهیدین جنگی هستند همان قسم که من درامریکامیباشد). بلی اوضاع زنده گی ما خیلی خوب وخوبتر میشود. اززمانیکه من کمی دری آموختم، این یک از لسان های میباشد که در افغانستان صحبت میکنند. وقوماندان آزاده گان شهید احمد شاه مسعود به این لسان صحبت میکردند.

درامنیت ملی واقعاً سخت بوده است که هیچ کس انگلیسی نمی فهمید، ومجبور بودید که اگر میخواستی یا نمیخواستی باترورستان صحبت کنید. مانند بازی نمودن همرای قطه روز به روز زیاد یاد میگرفتیم. من زیادتر فهمیده میتوانم نسبت به سخن زدنم. ودرآینده امیدوار هستم که یک افغانستان سرفراز بوده باشد، وفعلا آنها بعد از 26 سال جنگهم شایسته هستند آیا فکر میکنید؟ به هیچ پروا ندارد چی شنیدید وچی خواندید هنوز هم جنگ ختم نشده است.

طالبان ودیگر ترورستان گروپ گروپ به دولت جا میگیرند، مخفیانه قدرت بدست شان داده میشود، ومخفیانه راوبط خود را با اشخاص سابق پیوند مکنند. شروع نموده به پلان های خیانت پزیر دست میزنند بخاطر خراب نموده امریکا وجبعه متحد. آن روز بهترین روز خواهد بود اطفال افغانستان ازهمه چیز سهولت داشته باشندمانند امریکا بخصوص برق، آب، سرک های آباد شاید یک روز این واقعه رخ خواهد داد مگر امروز هیچ خواب هم دیده نمیشود در این کشور چراکه ترورستان باری قدرت اینجا میباشند وهمه چیز پوشیده است وکوشش به کمین گاه در مقابل امریکا مکنند.

فکر من این است این اخبار را ازسی ان ان وازیک جای دیگر شنیدید مگر از آن بوت های که در سر سرک افتاده است وازآن روی های که در مقابل روی های ترورستان میباشد بپرسید. بعضی امریکایی ها بعداز واقعه 9/11 ازیاد بردند ویا حتا درباره آن روز هم فکر نمیخواهند کنند. این آسان است ازیاد ببرید ویا ازمغزتان بیرون بکشید. امریکا یک جای بزرگ است، جای که شما میتوانید زنده گی راحت بخش داشته باشید، وزنده گی آرام داشته باشید من از شما یک سوال مینمایم، ای مردم چطور روز 9/11 را ازیاد بردید ؟ آن یک زنگ بود که شما را از خواب بیداد کرد. حتا بعضی شما دکمه چرت را فشار داده بودید.

مردم میترسد که گردن خود را بیرون ویا خم نمایندمن تمام سر خود را بیرون وخم نمودیم چراکه من به قلب خود اعتماد دارم ومن در این باوردارم که این جهان زیبا بیدون ترورستان خوش خواهد بود، یک روز میشود ترورستان برنده شوند امریکا مجبور بی قدرت وقوت بنشیند واز طفلانما، ازفامیل های ما حفاظت نمایند مگر امروز آنروز نیست تا هنوز آن روز نیامده است.

گفتن وعمل کردن خیلی تفاوت دارد. برخیزید اگر ضرورت باشد قهوه بنوشید مگر باید بفهمید که ترورستان چطور رفتار میکنند. به من از خیلی اشخاص نامه آمده است، فامیل های ما ، دوستان، وازآن عده اشخاص که مانند ما فکر میکنند. گفتند که ترورستان باید گرفته شوند وبه چی دلیل وچطور آن ضرورنیست. مردم جهان مارا تقویت میکند. همرای نامه، کارت، وپاکت ها حفاظتی. همه میگویند که دولت امریکا باید به مایان مدال بدهند. درحقیقت سه روز پیش از دستگیری ما دولت افغانستان به ما گفته بودند که ازطرف ریس صاحب جمهور مدال تهیه شده است برای مایان.

من هنوز هم میخواهم بفهمم که چی واقعه رخ داده است بندی شدن درجای طالبان میباشد ویگانه جای که مردم شکنجه میشوند. ولیکن من افتخار مینمایم که درامنیت ملی یک شخص که مربوط به هوایی بوده است بندی شده ویا فورت برگ. من هیچ وقت درباره مدال، پول ، رتبه ویا کدام فکری شخصی کار وخدمت نکردم. فقط یک تشکری از طرف دولت همه چیز خواهد بود وکشور ما آباد بماند. مگر جورنالستان بدل اخبارهای عجیب وغریب رانشر کرده وهمه باورکردن، حتا فکر هم نکردن که ترورستان دروغ میگویند وقتیکه فهمیدن ترورستان دروغ گفته بودند برسر خود میزنند.

جک راست میگوید، من تعقیب میکنم جک را در جنگ ویا دوباره آمدن، من حاضر هستم که ترورستان را دستگیر نمایم البته هر وقتکه جک حاضر باشد. مگر جک دوباره پشت ترورستان میرود چراکه درخونش نوشته شده است بالاتر ازمدت 25 سال درمقابل ترورزم جنگیده است. پیش ازاینکه کسی بفهمد این چی معنی دارندودرمقابل کشور های ماچی خواهند نمود. چقدر خراب است که مطبوعات چی نوشته، ویا در ویبسایط چی بوده است. من در ویبسایط خویش افتخار مینمایم، من فکر میکنم مقبول معلوم میشود وبزرگ است. آن روز من خیلی خواهم شد که اولین نامه درباره ویبسایط خویش بیبنم و واقعاً خیلی با معلومات خواهد بود. ودرپیش مهربانی ها راخواهید دید. من آن عده که به ما کمک کردن تشکری منمایم، واین برایشان خوب خواهد بود که اصل قصه را بفهمند وبشنوند. خدا امریکا را زنده داشته باشد. 

وخداوند (ج)آن تعداد که بخاطر سرفرازی افغانستان کوشش میکنند آرام وزنده داشته باشد افغانستان یک کشوز بسیار نزدیک ودوست با امریکا میباشد. وهمیشه تا آخیر همرای جبعه متحد خواهیم بود.

محکمه قاضی بختیاری محکمه نبوده بلکه یــــــــک جلسه های کانفرانس بوده است البته مطابق بـــختیاری سه شــــاهد را تست نمود  یـــک از ایشـــان قسم به صـــداقت وراستی ننموده است تنها دلیل معلومات به مردم بوده است اگـــر حقوق را پـــــاین بــــــگزارید آن یــــــــک جلسه مطبوعاتی بوده است یک جلسه محکما تی نبوده است وصفارت امریکا بخاطـــــــــــرگفتن مردم رایـــــگان وجبعه اتفاق یک نفر ترجمان را برای نیمه روز تهیه دیده است.

قاضی درتمــــام جلسات حاضر بـــــوده درآخرین ورق حکم او گفته است که تمام ما همــــرای قـــوای مقاومت کــــار ووظیفه انـــــجام دادیم. وناوقتر مـــــــا فهــــــمیدیم که قاضی مـــربوط طالبان بوده است، ظــــــــاهراً، بعضی قسمت دولت کتهگوری های قوماندانان شهید احــــــمد شاه مسعود قوای نظامی متحد (مجاهیدین جبعه متحد) میباشد مـــــانند غیر قانونی ویا بیدون شناخت وتضاد درداخل دولـــت بــــوده، در حــــقیقت ایشان در جریان جنــگ در سال 2001و 2002 منسوب به دولت امریکا بــــوده است. محکمه و دولــت حــــامد کرزی این را هم نادیده گرفته است کـــــــه جبعـه متحد مربوط به شهید احــــــــمد شاه مسعود هم در سال 2001 پارت کـــــــــــانفرانس بن بوده است (قسمیکه شناسایی شده ایشان اشخاص مــــعقول، مشروع، و برحـــــــق به دولت  بـــــوده و اشخــــــاص کــــــه تبعیده شده هستند) وپـــــــارت دولت تعین گردیده هستند کـــــه تعغیر نمی کند تا دسمبر 2004.

Hereby request immediate Prisoner Of War status under the applicable Geneva Conventions for Protected persons relative to:  A) Combatants, B) War Correspondents, and C) Civilian Non-Combatants in time of war.

Specifically:

IDEMA, BENNETT, RASULI BANDERAS, EZMERAI, each claim POW status as combatant prisoners of war under the following circumstances and criteria;

1. Each were employed by the U.S. Counter-Terrorist Group;

2. Each carried their arms openly;

3. Each was responsible and subordinate to a commander.

4. The unit designation was Task Force 7, later changed to Task Force Saber/7, the unit, under the original name of Task Force Saber operated in Afghanistan against Taliban and al-Qaida forces since the start of hostilities in October 2001, and was from the start of the war until present time, subordinate to both, a commander in the United States and/or to the corps commanders of the United Front Military Forces in Afghanistan.

5. Each man wore a distinctive uniform and recognizable insignia;

   1. An American Defense Logistics Agency issue uniform;

   2. An American flag on the left breast and right shoulder [Lt Banderas & Major Amin also wore Afghan flags];

   3. Uniform standardized combat equipment (i.e., LBE, boots, etc.);

   4. A distinctive emblem on all aircraft and vehicles used in military operation (i.e., A/C N.A. symbol – American and N.A. flags);

   5. A distinctive I.D. card worn on military operations.

6. Each man operated according to the laws and customs of war and abided by the Geneva Convention;

7. Each man carried a Geneva Convention identity card with name, rank, duty, position, identity number, and organization.

The judge presiding over the various trials conducted announced during his final verdict that we were all part of or working for the “resistance forces.”  [It was later disclosed that this Judge was a Member of the Taliban].[7] 

Readers Note: How does a Taliban Judge end up presiding over the trial of Anti-Taliban Forces, specifically American citizens and Northern Alliance military officers?

A.  Prisoners of war, in the sense of the present Convention, are persons belonging to one of the following categories, who have fallen into the power of the enemy:

1. Members of the armed forces of the armed forces of a Party to the conflict as well as members of militias or volunteer corps forming part of such armed forces.
2. Members [This and #1 apply to Jack, Bennett, and the other Americans not originally captured/arrested by Karzai's Pro-Taliban government] of other militias and members of other volunteer corps, including those of organized resistance movements, belong to a Party to the conflict and operation in or outside their own territory, even if this territory is occupied, provided that such militias or volunteer corps, including such organized resistance movement fulfill the following conditions:
   1. that of being commanded by a person responsible for his subordinates;
   2. that of having a fixed distinctive sign recognizable at a distance;
   3. that of carrying arms openly;
   4. that of conducting their operations in accordance with the laws and customs of war.
3. Members of regular armed forces who profess allegiance to a government or an authority not recognized by the detaining power [Major Amin, Lt. Banderas- UFMF] [Northern Alliance].
4. Persons who accompany the armed forces without actually being members thereof, such as civilian members of military aircraft crews, war correspondents [Caraballo], supply contractors... [ ] provided that they  have received authorization from the armed forces which they accompany, who shall provide them for that purpose with an identity card similar to the annexed model.

قوای نظــــــــامی جبعه متحد، بسیار مشهور به جبعه اتفـــــــاق یاد میشود جبعه متحد درزیر امـــــــر قوماندان صـــاحب شهید احمد شاه مسعود بود دردوران ریاست جــــــمهوری استاد ربانی. درجریان رژیم طالبان ایشان یــک دولت برحق وقانونی بودند، و فعالیت های شان درغربت بوده است بانگاه نمودن شمال غرب افغانستان که امـــــــکانیت 15% نبوده در این کشور. این جبعه متحد صفارت های درست نمودن در واشنگتن دوشنبه، تاشکنت، دهـــلی،ولندن، دربین دیگر جاهای بوده.  جبعه متحد بطور بسیار خوب به ملل متحد وبه ایالات متحده امریکا  قابل شناسایی بودند، ومانند یک دولت مشروع، برحــــق وقوای مقاومت درمقابل اتحاد شوروی، وپسانتر درمقابل طالبان بودند.  بنــــــــابراین، بخاطـــــر تمام قــوای فعـــــالیتی یسبر /7 که عضوی های شان رسمی تماس داشته به جبــــــــعه متحد، جگرن امین، وبریدمن بندریس نماینده گـــــان خدماتی به جبعه متحد بوده، و این هـــــــــم واضع است که ایشان چی وضع وحالت دارند.
