Ed Caraballo, loosely quoting a recent  film on the eve before his arrest in Afghanistan in July 2004.

Edward Caraballo is from the Bronx, New York, born of Puerto Rican descent.  A Manhattan resident for most of his adult life, he is a four-time Emmy Award winning investigative journalist, with a background spanning the globe with twenty-five years in news reporting and documentary production.  Two of his Emmys were awarded for producing news specials, and two were for "outstanding editing" of  news documentaries and feature stories.

Ed has worked for CNN, CBS, NBC, ABC, HBO and others.  Ed has filmed and/ or edited specials and news reports for Anderson Cooper,   Dan Rather, Mike Wallace, Peter Jennings, Diane Sawyer, Connie Chung, Chris Cuomo, Robert Krulwich, Leslie Stahl, and, once, up in Albany, with John Miller- author of The Cell and the man who personally interviewed Osama bin Laden. 

Finding himself in the hot seat for working on controversial stories is no stranger to Ed who has also worked with Leonardo DeCaprio  on a project for ABC News called "Planet Earth 2000," a documentary about global warming that netted Ed's production team some bad headlines when ABC News Chief David Westin sent Leo to interview then President Clinton.  Westin quickly came up with a cover story, then lied, and claimed it wasn't actually an "interview" when the "real" ABC journalists in Washington got bent out of shape about the blurring of news and entertainment.  The issue was does a major news network send a movie star to interview the President.  The bigger issue was Westin lying about it.

Since 1993 Ed has operated Caraballo Video Inc. which produces documentaries, television pilots, and VNRs as well as provide broadcast production services to a variety of noteworthy clientele.. Before that he was part of  the award winning investigative unit at UPN's  WWOR.

Ed is currently with Task Force Saber/7 as an embedded journalist, after having provided an official written request for assistance to the United States Department of Defense and after having received their assistance with his travel authorization and visas.

From the beginning of the 2001 war in Afghanistan, journalists found themselves on the outside looking in.  The war, and how it was conducted was so secret and so concealed from public view, that the press rarely caught a glimpse of the Green Berets on the ground, and had virtually no idea of their operational activities.  This was the way it needed to be.  US Special Operations Forces worked in the dark and unseen.  The result was that the Taliban and al-Qaida forces fell before they even realized the US was waging a vicious guerilla war against the forces of evil that had killed so many Americans on 9/11.  However, by the end of the war, the Department of Defense realized that there was a downside to excluding journalists.  Swarms of reporters were competing for translators, gas, vehicles, and intelligence, with NBC, CNN, and the BBC often able to outspend the Green Berets and CIA agents on the ground.  Even more disturbing for the Pentagon was that journalists were frequently beating Green Beret operators to intelligence.  While the Green Berets were over-running enemy forces at an exponentially increasing rate, and literally racing across the enemy's defenses, journalists were coming in behind to scoop up documents, terror plans, and computers, left behind as the battle swept south from Khoja-Bahaudeen, across the Shomali Plains and east to the Tora Bora mountains.  So was born the embedded journalist idea by the Pentagon's top-secret Office of Strategic Information.  The next war, in Iraq, would embed journalists with military units, giving the Pentagon an almost invisible "tight leash" on the press.  The press would see more of the battle, but the way the Pentagon wanted them to see it.  The Green Berets, Delta Force, ISA, OSIS, and ultra-secret activities like GrayFox and TF11 would remain permanently in the shadows unobstructed by roving hordes of journalists.  Very few journalists would ever be allowed to actually see inside the black operations of America's truly clandestine services.  And even that would only be a glance at the fleeting shadows.

Following the Counter-Terrorist Group and Massoud's United Front Military Forces in 2004, Ed went places in Afghanistan where few journalists could or would.  He had access to private high-level meetings with CIA, NSA, DOS, DIA, and Afghan National Security Council officials.  He covertly taped meetings with actual al-Qaida terrorists, and with Jack's agents inside al-Qaida.  He has traveled extensively throughout Afghanistan from northern Mazar to eastern Jalalabad forming an unusual bond with the Afghan Mujahadeen he frequently lived with.

FIRST AMENDMENT RIGHTS:

Whether the FBI likes it or NOT -Newsgathering IS constitutionally protected:

It is important to begin by noting that the First Amendment's guarantee of press freedom is meaningless if journalists do not possess a concomitant right to gather the news. In Branzburg v. Hayes, 408 U.S. 665, 707 (1972), the U.S. Supreme Court recognized that the First Amendment's protection of a free press carries with it protection for essential newsgathering.

There can be no doubt that newsgathering, as well as the dissemination of news, deserves protection under the umbrella of the First Amendment. "News must not be unnecessarily cut off at its source," Justice Stewart wrote in 1972, "for without freedom to acquire information the right to publish would be impermissibly compromised." Branzburg at 728 (Stewart, J., dissenting, joined by J. Brennan and J. Marshall). See also Zemel v. Rusk, 381 U.S. 1 (1965) (recognizing that a right to gather news must exist in some form).

Newsgathering is essential to preserving a free press and the free flow of information, as "freedom of the press can be no broader than the freedom of reporters to investigate and report the news." 28 C.F.R. 50.10 (1998) (Attorney General's "Policy with regard to the issuance of subpoenas to members of the news media").

Yet not one single journalist protected Carballo's right to "gather" the news, instead choosing to vilify him as a gun for hire, rather than a four-time Emmy Award winning journalist.

Prisoner Of War status has become a hot issue in the War On Terror.  The legal grounds to deny POW and Geneva Convention status to al-Qaida, Iraqi, and Taliban terrorists is simple-- they don't meet the requirements of Rule 4 of the Geneva Convention for Combatant Prisoners.  Few terrorists do.  To see these rules, follow this footnote: READ RULE 4.

Terrorists don't wear uniforms, have ID Cards, carry their weapons openly, wear unit patches (what would it say? AQ Killer Group with twin burning towers as a logo?), nor do they follow any of the other guidelines required by Rule 4, except that they might be subordinate to a commander (like bin Laden, Hekmatyar, Mullah Omar, etc).   But being subordinate to a madman does give rise to GC protections, you must follow all of the requirements of Rule 4.

Notice the two kilos of plastic explosives that were hidden in Terrorist Serajan's pillow- The explosives were to be used to blow up gas trucks at Bagram Airbase and kill American soldiers.  Serajan is also seen being flex-cuffed by Jack and Brent in the graphic above:

The Geneva Convention Books about the laws and rules that certain bloggers say do not exist.

The press called TASK FORCE SABER / 7 personnel "mercenaries."  One headline from the NY Times (ala Jason Blair hype) is in some of our banners saying "Mercenaries in Afghan Case Get 8 to 10 years."  It is clear that these men are not, nor ever were mercenaries. See: GC Protocols Article 47.  The TF SABER / 7 Geneva Convention Legal Brief/Letter clearly forecloses any argument to even consider they are or were "mercenaries." 

It is undisputable that even Caraballo had Geneva Convention POW status as a non-combatant.  POW status is established by simply asserting the status upon capture or arrest in a conflict area.  At that point you have POW status.[1]  After that, it is up to the high contracting party to either accept or deny status.  However, status continues until such time as a Geneva Military Tribunal meets and either awards permanent status, or rejects status.  But, and this is an important but, from the moment of assertion, a person "in custody" or "confinement" has automatic status the moment they assert that status, either verbally or in writing.[2]

Within 24 hours TASK FORCE SABER/7 personnel asserted their Geneva Convention Status, and 60 days later they filed a complete legal grounds brief with the Central Information Bureaux in Geneva, and copied the Red Cross- the guardians of the Geneva Convention.[3]

Ed Speaks Out -

My name is Edward Caraballo, but, my friends call me Ed. Only my family is allowed to call me Eddy. My Afghan friends like to call me Najeeb.
 

I am a documentary filmmaker that came to Afghanistan to examine the state of the War on Terror through the eyes of one of America’s most unconventional weapons, Jack Idema.

To my friends, family, and media colleagues who may be concerned about my welfare and health, let me say that I am alive and quite well. On my answering machine, it says: leave a message....I'm on a shoot....a really long shoot. Actually I'm awaiting  my appeal in this odd case of being at the wrong place at the wrong time. I say this for my families benefit, who have suffered in this ordeal one hundred times more than I have, but from the perspective of being a student of the human condition, I couldn’t have been in a "righter" place, at a "righter" time to learn about this fledgling democracy of Afghanistan, the American influence here, the ineptitude and arrogance of the geniuses at the Federal Bureau of Investigation, not to mention the superficial reporting of stringers who gave credence to a bunch of terrorists and Taliban judges over us.  They all knowingly ignored MY First Amendment right to gather the news, while exercising their right irresponsibly- nobody bothered to check the law.

I first became interested in Jack’s story twelve years ago, when he was bossing around prison guards, staging hunger strikes, and generally being a pain in the ass to his captors in a Federal Penitentiary.  He was there because the FBI had set him up when he refused to give up his assets in Eastern Europe after briefing the Pentagon on the emerging threat of nuclear smuggling through Lithuania.  My colleague Gary Scurka and I flew to Lithuania to check it out, and everything Jack said turned out to be true, despite US government press conferences to the contrary.  Now it seems like deja v™ with the FBI setting Jack up again, this time using the Afghan NDS as their proxies and smearing myself, Brent, and anyone anywhere near Jack with the same ugly brush.  NDS (The National Directorate of Security) used to be the Afghan CIA when it was run by Engineer Araf under Commander Massoud, but it has recently been co-opted by the FBI, remade into an Afghan version of their own image.

I have been embedded with these guys for more than a year now, and I am proud to say that they are my friends and comrades, bonded by the experience of being hung out to dry together.   Brent and Zorro (shown to my left, above) are strong, true men; we always pick up each others spirits when one of us gets down.  Brent is hardly ever down.  He is one of the most even-keeled individuals I’ve ever met.

Jack is one of the most intelligent, creative, and dangerous individuals I have ever met.  He is a warrior of the battlefield, of the courtroom, and in the media.

The United States is spending billions in Afghanistan and I wanted to document how our tax dollars were being spent.  Traveling with Task Force Saber/7 was and is my all access pass.  Let me tell you, did I get an eyeful.  I've seen NGOs that take a million dollar cash advance contract to rebuild a school, but skip out after half the job is done.  I’ve seen overweight, over-armed, security guards make a thousand dollars a day to shop for carpets, while their Afghan counterpart earns sixty dollars a month.

Unfortunately, the majority of the modern western news media gatherers are a bunch of corporate minded lemmings, slaves to their official sources (a free-lance reporter cannot afford to question an official source- they risk being cut out of the loop at press conferences and photo opportunities).  Their job is to promote the most salacious stories that news agencies can maximize the profits on, repackaging the news into “content” and peddling it to consumers on their TV, computer, and even their mobile phones, like so many widgets.

An example of lemming-ism is the bait and switch coverage of the Northern Alliance; during the 2001 the US needed these allies to hunt the Taliban and Osama bin Laden, we (the U.S.) lionized these Mujahadeen warriors and lavished them with tremendous financial and military assistance.  It made sense since these were the only Afghans to fight the Russians and the Osama-harboring Taliban.  They were rewarded for their efforts with high positions in the Interim government and Ministry Of Defense.  Now these same Generals are called "war-lords" in the media; a concept/party line fed to them by their "official/anonymous" sources within the US State Department, Pakistani ISI and sundry American alphabet agencies... During the war Karzai was a military commander flown in with enough cash (from the CIA,) to quickly fund a private army.... That's a warlord! On the surface, the US  policy sounds reasonable; consolidate power in the country and you'll have a stable democracy.  After all, the Pashtun folks are a 60% majority. Slowly, but surely, the Northern Alliance, which was held together by Massoud's the Jamiat Political Party, was and quietly being replaced in their cabinet, Military Corp Command, Police Chief, and other official positions.  The word on the street here is even Gulbideen Hekmatyar (currently a U.S. Most Wanted List Terrorist) is soon going to be welcomed back into the government and removed from the wanted list.  We are basically giving power in the country to the same people that  supported the Taliban.  What was the point of fighting the war here in the first place?  How about loyalty?  Not to mention that these are a tough, experienced, and dangerous people to disenfranchise and double-cross, having spent their entire resilient lives fighting for their country.

These were my Press Credentials that were confiscated and in the NDS evidence room. After twenty years of covering media circus trials– the cases with sufficient scandal to capture the public’s imagination and interest– last August I found myself on the other end of the camera, in a surreal nightmare of an experience.

Translation was criminally misleading or simply absent during our trial.  I kept thinking the press would cover what a sham the events were, but most reporters simply parroted the (yes, you guessed it, anonymous) officials sources and the US State Department quote that the trial was fair.  Let me give you one example: the only time prosecution witnesses ever "testified," the prosecutor and the judge refused to swear them in under oath and insisted Jack call the terrorists "victims."  Mawlawi Sidiq (A "former" Taliban official, who worked for Hekmatyar— one of the world's most wanted terrorists and now appointed a "religious" judge in the new government) testified that he wasn’t allowed to go to the bathroom for twelve hours.  What the translator told the court packed with western journalists was that we hung them upside down, and burned them with boiling water and cigarettes… Oh My God… if I had heard this and I was covering the trial, I’d be jumping up and down, praising the news Gods for such a scoop.  But after my pulse returned to normal, I would want some verification of these outrageous claims. I must forgive my fellow reporters, for turning a blind eye to the lack of evidence on the prosecution's behalf.  After all, for these mostly freelance reporters working in Kabul, freelance "torturers" was a sexier story.  This was a chance to finally get some air time and print space– Iraq had long ago eclipsed  interest in Afghanistan.

Jack and his guys are out there, trying to make a difference.  While a lot of his critics claim he is a fraud it is in fact they who are the frauds and hypocrites– like the jilted reporter who begged Jack to write a book with and about him– and made a deal with a publisher before securing Jack's permission.  When Jack refused, Tod Roberson took his revenge with a series of vitriolic, slanted reports, kicking Jack while he was down.

And then there’s "At FOX News, The Colonel Who Wasn’t," (see New York Times article, 4/29/02, Jim Rutenberg) a wannabe who fooled FOX News into believing he knew what he was was a Special Forces Colonel with three Silver Stars who had served with Delta Force during the Iran hostage rescue attempt. In reality, he only spent 44 days in the military, and left as a private.  After Jack helped expose him, he began a relentless campaign to assassinate Jack’s character.  Joe Cafasso, the phony Colonel, did what he could to disrupt Jack’s livelihood and efforts to inform the American people about what his eyes have seen here in Afghanistan.

There’s the “famous author” and his writing assistant who published a bestselling book by Jack; who are now trying to make sure they keep Jack's share of the profits and keep Jack in prison.  But Jack didn't use his share of the profits for personal gain.  Barely keeping a roof over his own head, he spent most of it continuing to fight terror and support humanitarian endeavors.  I am told by reliable sources in the publishing industry that this same author has screwed “Popeye” Doyle, Xavier Hollander, and Mike Hoare, people who wrote books with his name on the cover, in much the same fashion.  It’s ironic that the same people who speak the harshest about Jack are the same ones who are first in line to make a buck off him.  A few months ago Random House turned down Robin Moore and his angry young side-kick’s written voodoo doll against Jack, tentatively entitled, “Smoke & Mirrors.”  At least Random House bucked the mainstream press with courage and integrity.

And then there is the media, who simultaneously loves and hates Jack.  They love his controversial style and front line imagery that generates ink and ratings; they hate him because he personifies and reflects the blurring of the line between the news gatherer and the news maker.  He has always been both.  Jack was countering terrorism before Americans knew what “CT” meant.  When he saw the War on Terror move into the milieu of the “war of public opinion,” he once again retrofitted himself with new weaponry: a word processor and the internet.  Jack won a National Press Club award for his reporting on the murder trial of his old friend and Special Forces commander who Jack spent a year of his life trying to exonerate, when he should have been exonerating himself.  In the words of ace news anchor Rolland Smith, a common friend of Jack and myself, “If Jack is your friend; he’ll do anything for you. If he’s not, he’ll do anything to you.”

If there is one thing I’ve learned about the muse of my documentary, my somewhat high-strung, Green Beret friend Jack, is to never count him out. Jack is truly the comeback kid.
 

While it’s true he could be at times a royal pain in the ass, there is nobody who I’d rather have my back in a dark alley or in an international war against ruthless, suicidal fundamentalists who use God’s name to blow up women & children and cut off the heads of innocent aid workers, innocent contractors, and somewhat innocent Western  journalists.

From what I have learned from my travels in a Muslim country, it is my feeling that the entire War On Terror is basically a religious/political war between Muslims, Jews and Christians.  A real sore spot for Muslim people is the lack of a Palestinian State, and America's  seeming bias towards Israel.

For 2000 years, they have all savagely engaged in history's longest running real estate dispute.  Each religion has a prophet that had a vision of God bequeathing Jerusalem and it's environs to them.  I'm curious about what a probate judge would say when presented with such evidence.  "In the Case of; Jews Vs. Palestinian Muslims... Counselor, did your client get something in writing from God in regards to this bequeath of land?" 

Each religion feels that region is the most holy, and that it belongs to them.  I feel that every piece of land where a person that prays and communes with God is equally holy.  Why fight over it?  Each religion feels their God is the only true God and every other religion is heathen. It just doesn't make sense to me... doesn't it seem more likely the same all mighty architect designed all humans? Each culture and religion should get over the primeval, tribal self-defense mechanism of "us" vs. "them."  We are all inter-reliant droplets, part of a power greater than ourselves.

Many American, Afghan and Allied lives have been lost freeing this country and building a new democracy.  The Afghan people, even my prison mates here at Pulacharke (at least the ones not trying to kill us on a regular basis) constantly express gratitude to me for the American efforts to free this land. 

I consider my current dilemma to be a minor setback, a flesh wound to my own humble efforts to document the and illuminate the War On Terror, a scar to my reputation that I will wear as a badge of honor as long as I live.  My experience over the last year has been one of the richest of my life, I hope to accurately capture it– these beautiful, noble Afghan people and the Americans that came to their aid– in my film one day.  Coming soon... maybe this Christmas or, if the FBI has their way, Christmas 2012.  But I will make my film one day.  May God continue to bless America, and may the noble and hospitable people of Afghanistan see the peace and prosperity that they so definitely deserve.

برای دوستان، فامیل، جای وظیفوی من البته رسانه ها، کسانیکه بخاطر صحتمندی ما واوضای زنده گی ما تشویش دارند، مرا اجازه بدهید که برایتان بگویم من زنده وصحتمند هم میباشم، من بادست خود مینویسم وآماده گی برمحکمات میگیرم، کیس متفرقه ما در جای غلط ودروقت غلط بوده است. من 12 سال پیش آشنا به قصه های جک شدم، در آن زمان اوریس بندیخانه بوده، من ودوستم گری سکرکاومن به کشور لتوانیا سفر نمودیم بخاطر سیاحت، وچیزیکه آقای آیدیما گفته بوده به همان شکل یعنی به واقعات تعغیر یافته است، باوجود که دولت ایلات متحده امریکا با کانفرانس مطبوعاتی مخالف بوده است. مگر حالا اینطور معلوم میشود که دیجاوو وهمرای اف بی آی دوباره شروع نمودن تا بالای جک کامیاب شوند، این بار امنیت ملی افغان هارا مانند نماینده گان خودشان استفاده نموده است. که مارا هم درهمان جمله ملوث نمودند. خود من، برینت، وباقی مانده اشخاص گروپ جک را. امنیت ملی که سی آی ا افغان میباشند وقتیکه ریس عمومی امنیت ملی انجنیر محمد عارف بوده البته در زیرنظر قهرمان شهید احمد شاه مسعود، مگر حالا توسط اف بی آی پیش میرود وبنام افغان کار خویش را پیش میبرند.

من یک سوپرپتروتس هستم که شما مردم با عزت خواهید صدازد. من همرای دوستانم تقریباً یکسال می شود که فرورفتیم ومن افتخار میکنم که بگویم دوستان دارم ورفیق وهمدم دارم، قید شدیم توسط تجربه اگر دربیرون آویزان هم کند یکجا خواهیم بود. برینت وزورو (درطرف چپ من خواهد قرارگرفت وهمچنان قوی هم هستند ایشان اشخاص راستکار وصادق میباشند ما همیشه یک دیگر خود را خواهیم برداشت برینت همیشه خود را در زحمت قرار خواهد داد اویک شخصیت بوده که من درتمام زنده گی هم اولین شخص به این مرووت دیدم).

جک یک شخص بسیار لایق بوده، قوی وخطرناک همبوده است، که من درتمام زنده گیهم اورا ملاقات نموده هستم. اویک شخص جنگی بوده ودر زمین جنگ میباشد ازدشت شروع تا اطاق محکمه وحتا تارسانه های گروهی.

دولت ایلات متحده امریکا به افغانستان بیلیون ها دالر را مصرف نموده است ومن میخواهم که نشان بدهم که چط این پول ها مصرف شده است. سفرم با قوای فعالیتی سیبر/7 بوده که در هرجای به آسانی ها مواجه شدم وسهولت در کارهایم بوده است. اجازه بدهید که برای شما بگویم، آیا من زیاد چیزهارا دیدم. من اینجو ها را ملاقات نمودم که میلیون ها دالر را میگیرند بخاطر آبادی یک مکتب لیکن در بین کار میگریزند وکار نیمه تمام ماند البته به چندین جاها. بالاتر ازهمه بادیگارد های را دیدم که روز یک هزاردالر امریکای معاش دارند که ایشان در دکان های قالین فروشی مصروف هستند. مگر درهمان وقت یک افغانی بیچاره در یک ماه که بسیار زحمت هم میکشد شصد دالرامریکایی معاش دارد.

بدبختانه اندازه گیری اخبارهای غربی واشخاص که درآن رسانه ها کار میکنند عبارتند از چندتن اشخاص کوربوده که ایشان به آقایان شان مانند بنده بوده است. (یک خبرنگار نمیتواند که یک سوال رسانه را پرداخت کند – چرا که میترسند ازجلسات وکانفرانسها اخراج نگردند) وظیفه های شان این بوده که فقد ارتقاع نمودن قصه های شهرت انگیزونماینده گان اخبار که بتوانند بالاترین منفعت راکسب نمایند.

یک مثال: که ازخود دروغ های ساخته اند البته درباره جبعه متحد: در سال 2001 دولت امریکا به اشخاص جبعه متحد ضرورت داشته بخاطر شکار طالبان واوسامه بن لادین،  وبه ایشان ضرورت داشته بخاطر که بین آنها واینها مشاور باشد، مجاهیدین جنگی هستند، جنگیدن بخاطر دفاع ازکشور خود، ودرجریان جنگ پول فراوان برایشان میدادند تعلیمات نظامی وجود داشته، اوضاع مالی شان خوب بوده است، اجناس نظامی کمک میشده همه این تازمانیکه در مقابل روسیه جنگیدن ودرمقابل طالبان. بعد از جنگ یک پاداش کوچک برایشان داده شده بود دوباره از پیش شان گرفتند. وهمان جنرال های که بخاطر ناموس وکشور جنگیده بوده بنام جنگسالاران یاد میگردند. والبته توسط رسانه های خبری ودپارتمنت امریکا وآی سی آی پاکستان به این نام ها یاد میشوند. در جریان جنگ کرزی یک نظامی بوده است با پول گزاف ازطرف سی آی ا امریکا البته یک بودیجه نظامی مخفی بوده است...آن یک جنگسالار میباشد. در آواز امریکا معقول بوده وبه امردیگران در کشور قدرت داشته ویک دمکراسی مانند طویله، آن تعداد که مجاهیدین بنام جمعیت اسلامی یاد میشدند آهیسته آهیسته ازجنرالی وازقوماندانی پس میشوند. وحالا گلبدین هیکمتیار شخصی که در جهان ترورست سوم میباشد درهمین روزهای نزدیک ازاوخوش آمدید میکنند ودولتین اورا ازلیست ترورستی دورنموده هستند. ما اصلاً قدرت را بدست این قسم مردم تسلیم میکنیم. این دولت طالبان را تقویت میکنند. چراجنگیدن، چرانام ازصداقت میبرند، چرانام ازسرسختی نمیبرند، چرانام ازخطر مردم نام نمی برند که دبل کراس میباشند.

این استوارنامه مطبوعاتی من بوده که وتمام اجناس من ظبط شده دراطاق اسناد امنیت ملی. بعداز بیست سال پوشیدن رسانه های خبری وجلسات جولانگاه. این کیس رابخاطر به این شکل وارد ساختن همرای شایعات ننگ آور کافی بخاطر دستگیری خیالات مردم. آگیست گذشته من خود را درآخیر کمره پیدا نمودم ودریک کابوس غیر باورکردنی وباتجربه.

درجلسات محکمات ما ترجمعه جنایتکارانه و گمراکننده بوده است. من کوشش میکردم که فکر کنم چرا مطبوعات این را میپوشانند این رویدادها شرم آوربوده مگر بعضی خبر نگاران باساده گی وطوطیانه میگفتند(بلی شما حدس زدید در این باره) مگر همه این در دست سرچشمه دپارتمنت امریکا که نقل وزکر مینموده است ومیگفتند که این یک محکمه قانونی است. اجازه بدهید یک مثال بسیار خراب برای شما بگویم: برای یک بارسارنوال شاهیدان را امتحان نمودکه البته ایشان کسان بودند که ترورستان وتوسط جک دستگیر شده بودند بنام اسیر یاد میشدند. مولوی صدیق (یک کارمند رسمی طالبان وکسیکه برای گلبدین هیکمتیار کارمیکند) کسیکه درجهان بخاطر دستگیریش تلاش است. وفعلاً بنام قاضی مذهبی گفته برایش جا داده است. در جریان تست شدن گفته که ما اورا برای مدت 12 ساعت به تشناب اجازه ندادیم، مگر ترجمانان درمحکمه درمقابل جورنالیستان غربی گفته اند که ما گویا آنهارا ازپا آویزان نمودیم وبا آب جوش وسیگریت سوختاندیم... اوخدای من... آیا من این سخن را قبلاً شنیده بودم ومن این را درجلسه محکمه پنهان نموده باشم. من میخواستم ازبالا به پاین خیزبزنم وستایش خداوند(ج) را بکنم بخاطر این خبر تازه که بدست روزنامه ها میرسد. مگر بعداً نورمال شدم، من میخواستم که باید بعضی اثباتیه بفهمم که این شکایات تجاوزکارانه درمقابل ما نمودند. من باید این همقطارانم که بعضی خبرنگاران را ببخشیم. برای که کورکوانه درمقابل اسنادهای سارنوال قرار داشته اند. بعد ازهمه آن خبرنگاران درکابل کار میکنند البته به چندین اشخاص کارنموده که این پیشه آنها میباشد. درآخیر این یک چانس بوده که ما این اوراق را چاپ نمایم. عراق خیلی سابق خسوف افغانستان بوده است.

جک وکارمندانش به بیرون بودند بخازطر که یک تعغیر داشته باشند. تازمانیکه درمقابل اوانتقاد بوده ومیگفتند که کلابرداری نموده است. درحقیقت آنها کلابردار میباشند واشخاص ریاکاربودند میباشند. مانند آن خبرنگاران ازنزد جک مانندخیرات میخواستند که دربارهش وهمراهش یک کتاب بنوسد لیکن جک مستردنموده وامروز در مقابل جک بیوفایی نمودند.

در اخبار فاکس گفته، دگروال کی بود"(ببنید اخبار نیورک تایمز را 4/29/2 جیم اوتین بیرگ) یک کسیکه کیخواهد احمق باشد اخبار فاکس راباور کنداومیفهمید که اودرباره چی وکی صحبت میکند. کسیکه در اسپیشل فورس دگروال بوده سه ستاره نقره دربالای شانه خود داشته وکسیکه خدمت نموده همرای دیلتا فورس درجریان گروگانان ایران بخاطر نجات آنها زحمات فراوان کشیده است.

وبعداً رسانه ها که همزمان جک رادوست دارند ونفرت همدارند، آنها جک را دوست دارند سیتیزه جوی جک را که جوهر تولیدی است ونفرت دارند بخاطر که شخصیت میباشدو لک نمودن خط بین اخبا وکسیکه اخبار میسازد. او همیشه به همین دوجانب قرارداشته درنظر همان مردم. جک گروپ ضدترورزم است، پیش ازاینکه امریکابفهمد (ض ت) چی معنی دارد. وقسمیکه اوجنگ درمقابل ترور دیده است دربین جنگ حرکت نموده بخاطر نظر مردم به همان کاربوده است. اویک بادیگر خودرا آماده ساخت تمام چیزی خود را نو نموده ازطریق لغات وانترنیت. جک جایزه مطبوعات ملی را برنده شده است، بخاطر خبرنگاری دوستش که کشته شده بود البته دوست خیلی سابقهش بوده ویک قوماندان که جک بخاطر او یک سال کوشش نموده تا اورا مرخص بسازد.  رولاند سمید دوست جک وامن هم بوده، اگر رفیق جک باشید هرچی ازدستش بیاید دریغ نمکند واگردوست جک نباشید هرچی ازدستش بیاید درمقابل تان خواهد کرد.

یک چیزیکه من آموختم این بوده است. درباره قهرمان که درفلم من است عبارت از جک آیدیما میباشد کسیکه بمن نشان داده چقدر یک گرین بریت خوب ولایق میباشد. وجک یک شخص راسکار وهمیشه درهردوست خود هرجایکه باشد سرمیزند.

چیزیکه ازسفرم در کشورمسلمانان آموختم این بوده است جنگ وترور دربین مذهبان بوده است دربین مسلمانان، جویش، وعسوی مذهبان یک رنجش واقعی که برای مسلمانان بسخت بود فلسطنی ها وامریکا ظاهراً درکجی پیشرفته وهمرای اسراعیل بوده است.

برای 2000 سال درقصه های دوری ازیک زمین حقیقت را درجنگ بیان میکند. هرمذهب پیغمبر دارند که چیزی ازنزد خداوند(ج) برایشان مانند تحفه بیاورد. جیرسالیم که یک شهر اسراعیل میباشد برایشان توابع بوده است. من نمی فهمم که فیصله اصلی قاضییان چیبوده است.

هرمذهب ظاهراً احساس میکند که این زمین مقدس است، وآن مربوط به همان میباشد، من احساس میکنم هر که باخداوند(ج) رازنیاز دارد همان جا مقدس میباشد. چراجنگ ختم نمیشود هرمذهب فکرمیکند که خدای شان حق است ودیگر مذهب ها کافر میباشند  درحقیقت خداوند(ج) یکی است. به من فرق ندارد که هرکلتور ومذهب فکرکردن را اسناد نمایند. ما همه در دریای انسانیت هستیم وکمک واحترام به دیگران داریم.

افغانان وبعضی امریکایی ها به خاطر آزادی این کشور میکوشند بخاطر یک دمکراسی جدید. دربندی خانه پلچرخی (حتا یک بارنبوده که با قصد کنند تا مارا ازبین ببرند) من درخداوند(ج) روی میآورم که اول خداوند(ج) دوم این افغانان وسوم امریکایی ها این کشور را آزاد بسازند.

من تشویش  میکنم وضیعت دشوار فعلی یک کوچکتر مانع باشد، یک زخم درگوشت خودمن باشد که بخاطر جنگ درمقابل ترور، یک نشان زخم درشهرت من باشد که تاوقت من زنده هستم لباس عزت خواهم پوشید. تجربه من نسبت به سال گذشته خیلی زیاد شده وبهتر شده است. امید است این دستگیری یک روز درفلم من باشد. خداوند(ج) امریکا را آرامداشته باشد، درپهلوی ان خداوند(ج) این مردمان مهمانواز افغانستان را زنده وآرام داشته باشد که یک صلح وآرامی را دراختیار خویش قراربدهند.

قــــــانون جینواکانوینشن خیلی واضع گفته است دربخش سوم ودرماده 72  که البته دربــــاره حق دفاعی بوده است وگفته که هرمتهم حـــــق دارد کـــــــه از ترجمـــــــــانان ومنحیث معاون استفاده  درجریان تحقیقـــــــات دادرسی ها وجلسات محـــــکمه کمـــک بخواهد واین حق را هم دارند کـــــــه بخاطــــــر تبدیلی ترجمانان اعتراض به تبدیلی آن کنند.

عبدالباسط بختیاری طالب کـــه دایماً این قاعده هـارا مشکستاند وخـــلاف ازقانون مینمود وهیچ جـــــورنالیست بطـــور درست راپورنداده است لیــــکن بعضی گفته است که ایشان مشکل در ترجمـــانی دارند.

برای زرو اجازه نداده بودند که برای جــــــک ترجمانی کند در جــــــــریان جلسات محکمه در حقیقت زرو به جک گفت کــــه ترجمه مکمل غلط بوده وچیزی که سارنوال نگفته است اوتکراراً ازدلخود ترجمه نموده است وقتیکه زرو کوشید کــــــه ترجمه نماید وقتیکه درصدارت وامنیت ملــــــی برگشت نمودند ازطرف امینت ملی واف بی آی برای 30 روز زولانه گــــردیده است البته ازطــــــــرف امراله در24/7 میباشد.

ترجمانان قاعده های بین الملی را پامــــــال نـــموده است این اشخاص بخاطـــــــر احترام در قانون جینواکانوینشن که بخاطر بندی های جنگی میباشد وقاضی عبدالباسط بختیاری که تخلــــف ونادیده گرفته است قــــانون بین الملـــــــی را وتوسط این دولت قـــانون بین الملـی امضا گردیده است دردسمــــــــبر 10/1948 درزیرنظر یــــــک جنرال ملل متحد اسمبلی ریسه لوشن 217 بخش سوم که بطور آشکار این قانون را خلاف نموده است این کـــدام اپشن نبوده این قانون بین الملی است اگـــــرافغانــــــستان ضرورت به این قـــــانون دارد مکلف است که این قــــانون را تعقیب نمـــــایند اگر کمپنی انجو هرکه بودند درباره پول که به این کشورکمک میشد فعلاً کناره خواهد گرفت.

محکمه قاضی بختیاری محکمه نبوده بلکه یــــــــک جلسه های کانفرانس بوده است البته مطابق بـــختیاری سه شــــاهد را تست نمود  یـــک از ایشـــان قسم به صـــداقت وراستی ننموده است تنها دلیل معلومات به مردم بوده است اگـــر حقوق را پـــــاین بــــــگزارید آن یــــــــک جلسه مطبوعاتی بوده است یک جلسه محکما تی نبوده است وصفارت امریکا بخاطـــــــــــرگفتن مردم رایـــــگان وجبعه اتفاق یک نفر ترجمان را برای نیمه روز تهیه دیده است.

قاضی درتمــــام جلسات حاضر بـــــوده درآخرین ورق حکم او گفته است که تمام ما همــــرای قـــوای مقاومت کــــار ووظیفه انـــــجام دادیم. وناوقتر مـــــــا فهــــــمیدیم که قاضی مـــربوط طالبان بوده است، ظــــــــاهراً، بعضی قسمت دولت کتهگوری های قوماندانان شهید احــــــمد شاه مسعود قوای نظامی متحد (مجاهیدین جبعه متحد) میباشد مـــــانند غیر قانونی ویا بیدون شناخت وتضاد درداخل دولـــت بــــوده، در حــــقیقت ایشان در جریان جنــگ در سال 2001و 2002 منسوب به دولت امریکا بــــوده است. محکمه و دولــت حــــامد کرزی این را هم نادیده گرفته است کـــــــه جبعـه متحد مربوط به شهید احــــــــمد شاه مسعود هم در سال 2001 پارت کـــــــــــانفرانس بن بوده است (قسمیکه شناسایی شده ایشان اشخاص مــــعقول، مشروع، و برحـــــــق به دولت  بـــــوده و اشخــــــاص کــــــه تبعیده شده هستند) وپـــــــارت دولت تعین گردیده هستند کـــــه تعغیر نمی کند تا دسمبر 2004.

The file that Judge Bakhtyari concealed from everyone, except journalists that paid him under the table, contained extensive pictures taken by Caraballo which showed TASK FORCE SABER/7 in military uniforms, operating with international military forces, in meetings with top government officials, pictures of their vehicles- with Ministry of Defence license plates,[4] Afghan military ID Cards, Afghan military visas, and authorization documents from Commander Massoud's top-level Northern Alliance commanders and Interim government Corps Commanders. The Americans' US ID cards, US Passports, GC ID cards, and military authorization documents were immediately removed from evidence by the FBI and have never been seen again.  Why?  Because of Abu Ghraib.  The US government was still reeling from the Abu Ghraib pictures in July 2004, and were not about to be dragged into another abuse scandal.  These men were convicted by a Taliban Judge and a Taliban Prosecutor before the first day of trial ever began.  In fact, no witnesses ever testified against the defendants, nor was the defense allowed to call witnesses.[5]

Bakhtyari's Court basically held a press conference, because the three terrorists that did "testify" were not sworn in, and according Bakhtyari, were for "public information purposes only."  If you get right down to it, the trial was a press conference, not a trial.  Worse, the translator changed everyone's words.[6]

4. He is a well known journalist, having worked for CBS, ABC, NBC, CNN, UPN, and other networks for almost twenty years.  He has won numerous awards for journalism, including four (4) Emmy Awards specifically for news reporting [note: actually he has 25 years experience].

Note: See Articles 13(2), 13(3), 13(4) of the Geneva Convention entered into force 21 October 1950.  [US Embassy Consul Sandra Ingram refused to provide copies of the Convention to the prisoners in direct violation of International Law.]

The judge presiding over the various trials conducted announced during his final verdict that we were all part of or working for the “resistance forces.”  [It was later disclosed that this Judge was a Member of the Taliban].  Apparently, the government, has now categorized Commander Ahmad Shah Massoud’s United Military Forces (the Northern Alliance Mujahadeen) as illegal.[7]  

Readers Note: Exactly How does a Taliban Judge end up presiding over the trial of Anti-Taliban Forces, specifically American citizens and Northern Alliance military officers, and a journalist, when the Taliban Judges imprisoned more journalists than any other regime in the world?

A.  Prisoners of war, in the sense of the present Convention, are persons belonging to one of the following categories, who have fallen into the power of the enemy:

1. Members of the armed forces of the armed forces of a Party to the conflict as well as members of militias or volunteer corps forming part of such armed forces.
2. Members [This and #1 apply to Jack, Bennett, and the other Americans not originally captured/arrested by Karzai's Pro-Taliban government] of other militias and members of other volunteer corps, including those of organized resistance movements, belong to a Party to the conflict and operation in or outside their own territory, even if this territory is occupied, provided that such militias or volunteer corps, including such organized resistance movement fulfill the following conditions:
   1. that of being commanded by a person responsible for his subordinates;
   2. that of having a fixed distinctive sign recognizable at a distance;
   3. that of carrying arms openly;
   4. that of conducting their operations in accordance with the laws and customs of war.
