Major Ezmerai Amin is from the Panshir Valley in Northern Afghanistan.  His entire family has fought the Soviets, then the Taliban, the Wanted Terrorist Gulbideen Hekmatyar, and Osama bin Laden.  For more than 25 years Major Ezmerai's family fought in defense of Afghanistan giving their blood, and their lives.  His entire family, cousins, brothers, and relatives fought for Massoud and worked with U.S. Special Forces.

During the 2001 war, Major Ezmerai was with the Panshir Commandos in Khoja-Bahaudeen, where TIGER 03, the U.S. Army Special Forces A-Team led by the most famous Green Beret of the War, Master Sergeant John Bolduc.  TIGER 03 destroyed more Taliban and al-Qaida forces than any other unit in the entire war.  At the time Major Ezmerai was a Major with the Panshir commando unit and later became the commander of the Communications of the 1st Base of the Panshir, under the command of General Gada, one of Afghanistan's most famous Generals, and the man who is called the father of the Mujahadeen.

Throughout the war Major Ezmerai remained a serving officer in the United Front Military Forces (Northern Alliance).  In late 2001, after Kabul had fallen, General Gada, at the request of Marshal Fahim and the Chief of Foreign Military Affairs, assigned Major Ezmerai to Jack and TASK FORCE SABER (prior to the formation of TF 7 and TF SABER 7).  Major Ezmerai took over the Close Protection Detail assigned to Jack, and the command of the compound security officers at Jack's Kabul headquarters across from General Gada and one block from Marshal Fahim's compound in Wazir Ahkber Khan.

Upon the creation of the Afghan Ministry of Defense, Ezmerai was reassigned to the Interim government's MOD and continued his position at the 1st base of the Panshir.  Like Zorro, Ezmerai has followed the way of Massoud since he was a young boy, often visiting Massoud's grave and remaining loyal to the battle against terror, in his country, and the world.  When jack returned to Afghanistan in 2004, General Gada approved Major Ezmerai returning to Jack's unit.

جگرن ازمری امین ازدره پنجشیر میباشد، درشمال افغانستان. تمام عضوی فامیلش درمقابل شوروی جنگیده وبعداً درمقابل طالبان ودرمقابل گلبدین هیکمتیارواوسامه بن لادین. بیشتر از25 سال فامیل جگرن ازمری بخاطر دفاع ازکشور جنیگیده است، خون خویش را فدانمودند وزنده گی هایشان را فدای این کشور نموده هستند. تمام عضوی فامیلش، پسران کاکا وبرادرانش وخوشاوندانش بخاطر مسعود جنگیدن وهمرای قوت های اسپیشل فورس امریکا کمک نموده هستند. درجریان جنگ سال 2001. جگرن ازمری همرای قوت های کمندو پنجشیر درخوجه بهاودین بوده درجای که گروپ پلنگ 03 اسپیشل فورس امریکا بودند. که آن تیم توسط یک گرین بریت امریکایی بنام  ماستر سیرجینت جان بولدک یاد میشد. گروپ پلنگ 03 زیادتر طالبان را ازبین برده است نسبت به تمام دیگر قوت های جنگ. درآن وقت جگرن ازمری یکی ازعضوی کمندوی پنجشیر بوده وبعداً قومندان مخابره برای اولین بیس پنجشیر تعین شده بود، البته در زیردست جنرال گدا که درافغانستان مشهورترین جنرال یاد میشود وپدر مجاهیدین هم یاد میکنند.

درجریان جنگ ازمری همرای قوت های جبعه متحد بوده وبعداً درسال 2001 وقتیکه کابل شکست خورد جنرال گدا به خواهیش مارشال محمد قسیم فهیم وبه خواهیش ریس خارجه افغانستان به جک وقوت های سیبر/7 روان نموده است. ازمری بعنوان آمرحفاظت جک تعین شد، وقومندان امنیتی اداره مرکزی جک که نزدیک مرکزیت جنرال گدا ویک سرک تیرشده ازکمپوند مارشال فهیم در وزیراکبرخان بوده است.

دربین وزارت دفاع افغان جگرن ازمری امین ازداخل وزارت به اولین بیس پنجشیر تبدیل شده بود. مانند زورو ازمری هم راه مسعود را تعقیب میکرد از زمانیکه بچه جوان بوده، بسیاری وقت در سرمرقد شهید آزاده گان رفته به دعا  مصروف میشود به صداقت مندی مسعود شهید وجنگ در مقابل ترور فکرمیکند، بخاطرکشورش وبخاطر جهان. وقتیکه جک درسال 2004 به این کشور آمده جناب جنرال گدا ازمری را دوباره به جک فرستاده است. چند تصویر دربالا اززمان سال 2001/2002 درجریان جنگ ودرسال 2003 میباشد. یک خانم وسه طفل دارم وبه مدت 21 سال سربازبودم شما به من نوشته میتوانید؛

Prisoner Of War status has become a hot issue in the War On Terror. The legal grounds to deny POW and Geneva Convention status to al-Qaida, Iraqi, and Taliban terrorists is simple-- they don't meet the requirements of Rule 4 of the Geneva Convention for Combatant Prisoners.  Few terrorists do.  To see these rules, follow this footnote: READ RULE 4.

Terrorists don't wear uniforms, have ID Cards, carry their weapons openly, wear unit patches (what would it say? AQ Killer Group with twin burning towers as a logo?), nor do they follow any of the other guidelines required by Rule 4, except that they might be subordinate to a commander (like bin Laden,  Mullah Omar, Hekmatyar, etc).   But being subordinate to a madman does give rise to GC protections, you must follow all the requirements of Rule 4.

Some people say that one man's terrorist is another man's freedom fighter.  Cute saying, but not legally correct.  Freedom fighters and guerillas, historically, wear uniforms- no matter how ragged or mismatched, they carry their arms openly, rarely target civilian women and children, have military ranks and often have Identity Cards. One of the best examples includes Commander Massoud's Northern Alliance 1996-2004 and his Mujahadeen movement which Major Ezmerai fought with against the Soviets for ten years.

The Geneva Convention Books about the laws and rules that certain bloggers say do not exist.

The press have called TASK FORCE SABER 7 personnel "mercenaries."  One headline from the NY Times (ala Jason Blair hype) is in some of our banners saying "Mercenaries in Afghan Case Get 8 to 10 years."  It is clear that these men are not, nor ever were mercenaries. See: GC Protocols Article 47.  The TF SABER / 7 Geneva Convention Legal Brief/Letter clearly forecloses any argument to even consider they are or were "mercenaries." 

It is undisputable that all seven of the defendants had Geneva Convention POW status.  POW status is established by simply asserting the status upon capture or arrest in a conflict area.  At that point you have POW status.[1]  After that, it is up to the high contracting party (one of the countries that is a party to the conflict) to either accept or deny status.  However, status continues until such time as a Geneva Military Tribunal meets and either awards permanent status, or rejects status.  But, and this is an important but, from the moment of assertion, a person "in custody" or "confinement" has automatic status the moment they assert that status, either verbally or in writing.[2]

Within 24 hours TASK FORCE SABER 7 personnel asserted their Geneva Convention Status.[3]

Ezmerai Speaks Out -

My name is Ezmerai Amin, and I have fought with my friend Jack for three years against the terrorists. When my great Commander Massoud was alive we followed him because he was honest, kind, and brave as lion.  Now we follow his way because it is best for our country.  At the same time we see that our country is not changing, the terrorists are back and the Taliban is coming back in power. 

If Commander Massoud was alive none of these things would be happening.  For 23 years we have fought all invaders in our country.  The Panshir has never been taken by the Taliban, or the Russians, or anyone else.  We were the first allies of America, and in the need, will be the last to leave America's side.  But we are not stupid simple people either.  American has deserted us the way they did Jack.  I ask Jack, why did America desert their best friends and the Northern Alliance, and Jack said because journalists lied about all our commanders being warlords.  How is Generals with 23 years of fighting Soviets and terrorists are now called warlords.  Was your first Minister of Defense, General Washington a warlord?  Why not?  He had his own army, he fought against invaders and oppressors.  He took from the enemy what he needed to feed his soldiers and clothe them. 

Maybe America should look at your own history before you call heroes that died and bled for my country warlords.  The Journalists made this name up, just like they made up the name "Northern Alliance," to sell TV.  These are the generals that led this country to freedom (with America's help, but our blood) and the Northern Alliance is the United Front, and our Army is the United Front Military Forces.  We were the official government, recognized by the United Nations, and when Karzai was hiding in America we were fighting and dying and I have many wounds to show this.  We were the only force the UN said was legitimate, but now journalists and American Embassy come and say we are all criminals and warlords and should be in jail while dockswashers run our country.  [Note to reader: "Dockswashers" are people that fled their country and came back to claim again that which they already sold- similar to American carpet baggers after the US Civil War]

Like Zorro says on his page, Commander Massoud  was right. But Massoud told us to follow his way, and like Zorro I have dedicate my life to follow the way of Massoud because to save my country and the world.  And my commander has too.  This is why our people follow Jack, because he follow Massoud's way.  One time when I was still in Pulacharke I was very sad, and I said to Jack, fuck Massoud, because we follow Massoud's way we are in prison.  Then Jack remind to me that Massoud would never give up, he would keep to fight to make real freedom not freedom only for the rich people.  We talked about how Massoud would not allow a road to be built to his village until all the country had roads.  But this government, they buy rich cars and build roads to their villages while people are still starving and with no doctors.

I have my own question for the world.  Al-Qaida are foreigners and have no place and no position in our government, but neither do Taliban.  They destroyed my country and killed my people.  So why are Taliban being allowed back in our government and why is America letting them make a decision about the future of Northern Alliance and for future of those people who helped the Northern Alliance and stood beside the  Northern Alliance in arms against the terrorists. How could my country and how could America let Taliban judges and Taliban Saranwals hold court for us and send us to jail for fighting them?

The picture of me above was taken with Jack  in Mazar when the Taliban were running away as we took over the country.  I was very proud to be on cover of an American book and better I love the part about Commander Massoud that was in the book.  Some people say the book is not true about Jack and I know it is because I was with him through the war, in the North, and in Tora Bora and in Logar, and Shah-i-Kot and other places.  When Americans and other foreigns (sic) would not help the Mujahadeen and would not help our wounded soldiers, Jack always did, even with his last things. Even if he knowed (sic) that there were no bandages or medicine left for him, he gave it to our people.

Now we are having our weapons taken away from us and left to be killed and have our families killed again by the Taliban.  We won these weapons with our blood and our lives and used them to first defeat the Russians and then the terrorists and now the American government deserts us, and stabs us in the back with a knife, then gives our country back to the terrorists.   We are grateful that American helped us, but now it is all for nothing because the terrorists and Taliban are coming back into the government.

The terrorists stand up in court and lie and say we tortured them but they have no marks, no proof, and they refuse to put their hand on the Koran and say their story.  All Muslims know that if a Muslim refuse to pray on Koran or put his hand on Koran and tell his story then he is lying.  Journalists trust these Taliban terrorists and think they tell the truth.  I was in Taliban jail during war and Taliban kill our women, our children and our soldiers.  They do not care about human rights and so we fought for justice and now America takes that justice away and decides to let the terrorists kill us and put us in prison with no proof.  Are you people crazy.

Every Commander in the Northern Alliance that fought with Jack and knows him has told me this is crazy.  No I am free, after the court found me innocent -- they found us all innocent but only the Afghans could be released because of Khalilzad and the FBI, what kind of madness is this, if Massoud were alive Jack and Brent and Ed, and all of us would be Champions of the Mujahadeen, not in jail with Taliban guards like we were at NDS.

نام من ازمری امین میباشد. ومن همرای دوستم جک برای مدت سه سال جنگیدم در مقابل ترورستان. وقیکه قوماندان بزرگوارمان زنده بود ما راه ایشان را تعقیب میکردیم بخاطر که او مرد صادق، مهربان، ودلیر مانند شیر بوده است. وحالا که ما راه او را تعقیب میکنیم بخاطر که برای کشور ما خوب میباشد. درهمین زمان کشورما تعغیر نکرده است، تروریستان دوباره آمده، وطالبان دوباره به قدرت شامل میشوند. اگر آمرصاحب امروز زنده می بود این چیزی ها رخ نمیداد، در طول 23 سال جنگ ما بخاطر سرفرازی این کشور جنگیدیم. پنجشیر درطول همینقدر وقت توسط طالبان، شوروی ودیگران گرفته نشده است. ما اولین متحده همرای امریکا بودیم، واگرضرورت باشد دراخیر پهلوی امریکایی ها را رها خواهیم کرد. مگر ما احمق نیستیم واشخاص ساده هم نیستیم.  امریکا ما را ترک کرده است بخصوص همرای جک راترک نموده است. من ازجک پرسیدم که چرا امریکا دوستان خود را (جبعه متحد را ترک کرده است). وجک گفت که بخاطر جورنالیستان که به دروغ گفته اند تمام قوماندانان جنگسالار هستند.  درباره یک جنرال که برای 23 سال جنگیده درمقابل شوروی، وترورستان جنگسالار. آیا وزیردفاع کشور شما جنرال واشنگتن یک جنگسالار بوده است. چرا نبوده؟ اونظامی شخصی داشته، اودرمقابل متجاویزین وظالمان جنگیده است. اواز دشمنان حق گرفته به سربازان خود غذا ولباس تهیه نموده است، میشود که امریکا در تاریخ خود نگاه نموده ودرمقابل قهرمانان ما اعتراض بیگیرد چراکه این قهرمانان خون خود را ریزانده دراین کشور وامروز جنگسالاریاد میشوند. جورنالستان  نام جبعه متحد را به این شکل ساختند، که تیلویزیون های خود رابفروشند. این جنرالان آزادی را دراین کشور آماده ساختند. ( همرای کمک امریکایی ها، مگربا خون ما) ونظامی ما از جبعه متحده است، وقیکه کرزی در امریکا پنهان بوده ما میجنگیدیم ومیمردیم ومن بسیارزخم ها دارم که نشان بدهم. یگانه قوایی بودیم که ملل متحد گفته بوده قانونی وبرحق میباشیم. وحالا جورنالیستان وصفارت امریکا آمده میگوید که ما گناه کار میباشیم، وجنگسالاران باید در بندیخانه باشند سگشویان به قدرت دراین کشور بیایند. (نوت به خواننده گانان: سگ شویان عبارت از آن تعداد اشخاص که از کشور فرارنموده وفعلاً دوباره آمده که قدرت بیگیرند واشخاص هستند که این کشور را فروخته بودند) تصویر که درپاین میبینید اشخاص که دراین کشور آزادی را آورده اند وخون خود را در مقابل طالبان والقاعده ریختاندن. که جنرال گدا شخص بزرگ بوده است. قسمیکه زورو گفته بود شهید احمد شاه مسعود راست گفته بودند، مگربما نصیحت کرده که راه اورا تعقیب کنیم. ومانند زورو که گفته من تمام زنده گی خود رافدای تعقیبی راه مسعود میکنم بخاطر که نجات کشورم وجهان، وقوماندانم همچنان. وچرا مردم ما راه جک راتعقیب میکند بخاطر که اوراه مسعود شهید راه تعقیب میکند. یک روز که من در پلچرخی بودم من خیلی ناراحت بودم ومن به جک  گفتم که درقصه مسعود نباش، بخاطرکه ما راه مسعود راه تعقیب میکنیم دربندی خانه میباشیم. بعداً جک به یادمن آورد گفت: مسعود هیچ وقت خود را ازدست نداده وتسلیم نشده درمقابل هر سختی ها، او جنگیده تا آزادی واقعی را در این کشور پیاده نماید، نبلکه آزادی برای اشخاص پول دارن. ما سخن زدیم که چرا مسعود شهید یک سرک در راه خانه خود آباد نکرده است، تازمانیکه تمام کشور سرک دارشدن. مگر دراین دولت موترهای بسیار قیمتی را برای خودشان خریده وآبادنمودن سرک ها بطرف راه خانه های خودشان میباشد درصورتیکه این مردم بیچاره ازگرسنه گی واز بیدون داکتری جانهای خود را میدهند.

من سوال خود را ازجهان میکنم که، القاعده خاریجی دردولت ما جای ومقام نباید داشته باشند چرا که آنها کشور مارا ویران نموده ومردمان مارا کشته هستند.  حالا چرا به طالبان اجازه داده میشود که دردولت ما باشد چرا امریکا  آنهارا اجازه میدهند که درباره آینده مجاهیدین وجبعه متحد وآن اشخاص که در پهلوی جبعه متحد استاد شده در مقابل ترورستان امروز درباره ما فیصله نمایند.

چطور امکان دارد که دولت ما وامریکا قاضی طالبان را وسارنوال طالبان را اجازه میدهد که محکمه ما را دایر نمایند ما را در بندی خانه روان کنند چرا که ما درمقابل آن طالبان جنگیدیم. تصویر من دربالا همرای جک در مزارشریف گریفتیم، درزمانیکه طالبان ازکشورما میگریختند. من خیلی افتخارمیکردم که تصویرمن درپشت کتاب باشد مهمتر ازهمه قصه درباره شهید احمدشاه مسعود باشد. بعضی مردم گفتند که این کتاب درباره جک واقعت ندارد لیکن من گفتم که من درجریان جنگها همرایش بودم البته درشمال افغانستان، درتورابوره، درلوگر، وهمچنان درشایکوت ودردیگرجاها. دروقیکه امریکایی ها ودیگر خاریجیان نمیخواستند کمک کنندبه مجاهیدین وبه سربازان که ازطرف مازخمی شده بودند مگر جک همیشه این کارهارا انجام میداد. حتا همرای کوچکترین چیزیکه میداشت. حتا وقتیکه میفهمید بنداژ نمانده است بازهم به این مردم کمک میکرد.

وفعلاً سلاح های مارا ازما گرفتند که ما باید کشته شویم، ودوباره فامیل های مایان توسط طالبان ازبین بروند. ما این سلاح ها را توسط خون خود گرفتیم، وتوسط زنده گی های خود، اولاً درمقابل شوروی استفاده نمودیم وبعداً درمقابل ترورستان والقاعده وحالا دولت امریکا مارا ترک نموده است. وما را ازپشت سر با چاقوزده است. ودوباره کشور ما را به ترورستان تسلیم نمودند، مارا غلط فکر نکنید؛ چرا که ازکمک امریکا خیلی خوش هستیم بلکه ما زیادتر به کمک ایشان بخاطر آبادی ضرورت داریم، مگر امریکا اگرچشمان خود را درمقابل طالبان کور بیگیرد خیلی بدبختی ها خواهد آمد.

ترورستان درمحکمه استاد شده گفتند که ما ایشان را جزادادیم، مگرهیچ مارک درجان شان دیده نمیشود، که ثابت نمایند ما ایشان را جزادادیم، ودست خود را بالای قران مبارک نمیگزارند که قصه اصلی خود را بکنند. دراسلام این خیلی واضع بوده که اگر دست خود را بالای قران کریم بگزارد باید راست بگویند لیکن این اشخاص این را مسترد نموده چراکه دروغ میگویند. جورنالستان به این ترورستان باورکرده وفکرمیکنند که این اشخاص راست میگویند. من درجریان جنگ  دربندیخانه طالبان بندی بودم ولیکن طالبان خانم های  ما راازبین میبردند، اطفال ما را ازبین میبردند، وعساکرما را ازبین میبردند. آن اشخاص درقصه حقوق بشرنبودند. ما بخاطر عدالت جنگیدیم وامروز امریکا عدالت را دوربرده واجازه میدهند که ترورستان درباره ما فیصله کنند تا ما را از بین ببرند، بندی کنند بیدون کدام ثبوت. آیا شما مردم دیوانه هستید.

هرقوماندانان جبعه متحد همرای جک جنگیده وجک را میشناسند. من آزاد شدم بعداز اینکه محکمه مرا بیگناه ثابت نمود ـ ـ محکمه تمام مایان رابیگناه کشید وگفتند که تنها افغان ها آزاد شده میتوانند بخاطر که خلیل زاد واف بی آی نمیخواهند وآنها دیوانه گشتند. اگر امروز مسعود شهید زنده میبود جک، برینت، واید قهرمانان در بین مجاهیدن شمرده میشد. نبلکه در بندی خانه طالبان همرای گارد های طالب قسمیکه ما درامنیت ملی بودیم.

دوسیه درمحــکمه مکمل بوده در حقیقت اسناد هـــای انکار ناپزیر ازمرد های قوای فعالیتی سیبر /7 وبندی های جنگی در زیر قانون جینواکــــــــانوینشن وپیوند نامه ها راهمرای مینماید هرچی که باشد به این اشخاص اجازه ندادند که دوسیه خود را بیبینند که به دفاعیه خود استفاده نمایند قاضی بختیاری که دوسیه را ازاین اشخاص پنهان نــموده است تنها به جورنالیست ها داده کــــه ایشان براش پول پرداخت نــــــموده است البته درزیر میز کارش که آن دیسیه دربرمیگیرد تصاویر قوای فعالیتی سیبر/7 را در ینوفورم نظــامی فعالیت همرای قوای بین الملی ملاقات ها بامقامــــات بلندپایه ورسمی دولت تصـــــــاویر اراده جات همــــرای پلیت وزارت دفاع و کارت هـــــای نظامی برید من زرو وجگرن امین که مربوط وزارت دفاع بوده گرفته است ویزه های نظـــــــامی افغانی و اوراق دادن صلاحیت ازطرف قوماندانان بلند رتبه شهید احــمد شاه مسعود میباشد کارت هـــای شناخت امریکایی پــــــاسپورت های امــــــریکایی کارت هــای جنیواکـــــــانوینشن واسناد های نظامی که همه فوراٌ توسط اف بی آی گرفته شده است وهرگز نخواهیم دید چرا؟ بخاطرکه در ابوگرب درجـــــــــولای 2004 تصاویر گرفتند که دولت امریکا ازآن میترسید بــــحرحال توسط قـــاضی وسارنوال طالبان روز های جلسه محــــــکماتی ماپیش میرفت.

تمـــــــام افغان ها مبارزه نموده است حتــــــا آن اشخاص کـــــه دستگیر نشدند وگریختن تمــــام افسرهــــای برای خدمت هستند هرکدام آنها رتبه های عالی در نزد جبعه متحــــــد دارند که در وزارت دفاع قبلی وظیفه انجام میدادند.

اخیراً درفبـــــروری 7/2005 درمحکمه استنـــاف افغانستــان یـک اعتراض بزرگ که توسط هردوکشور بود امــــــــــریکا و افغانستان که دریـــــک دادرسی کــــوچک البته اسناد های ارایه گــردید که التبه تصویری وغیر تصویری بود که از تروستان بوده که بیان نموده است که هیچ کسی ایشــــان را شکنجه ننموده است.
 

قــــــانون جینواکانوینشن خیلی واضع گفته است دربخش سوم ودرماده 72  که البته دربــــاره حق دفاعی بوده است وگفته که هرمتهم حـــــق دارد کـــــــه از ترجمـــــــــانان ومنحیث معاون استفاده  درجریان تحقیقـــــــات دادرسی ها وجلسات محـــــکمه کمـــک بخواهد واین حق را هم دارند کـــــــه بخاطــــــر تبدیلی ترجمانان اعتراض به تبدیلی آن کنند.

عبدالباسط بختیاری طالب کـــه دایماً این قاعده هـارا مشکستاند وخـــلاف ازقانون مینمود وهیچ جـــــورنالیست بطـــور درست راپورنداده است لیــــکن بعضی گفته است که ایشان مشکل در ترجمـــانی دارند.

برای زرو اجازه نداده بودند که برای جــــــک ترجمانی کند در جــــــــریان جلسات محکمه در حقیقت زرو به جک گفت کــــه ترجمه مکمل غلط بوده وچیزی که سارنوال نگفته است اوتکراراً ازدلخود ترجمه نموده است وقتیکه زرو کوشید کــــــه ترجمه نماید وقتیکه درصدارت وامنیت ملــــــی برگشت نمودند ازطرف امینت ملی واف بی آی برای 30 روز زولانه گــــردیده است البته ازطــــــــرف امراله در24/7 میباشد.

ترجمانان قاعده های بین الملی را پامــــــال نـــموده است این اشخاص بخاطـــــــر احترام در قانون جینواکانوینشن که بخاطر بندی های جنگی میباشد وقاضی عبدالباسط بختیاری که تخلــــف ونادیده گرفته است قــــانون بین الملـــــــی را وتوسط این دولت قـــانون بین الملـی امضا گردیده است دردسمــــــــبر 10/1948 درزیرنظر یــــــک جنرال ملل متحد اسمبلی ریسه لوشن 217 بخش سوم که بطور آشکار این قانون را خلاف نموده است این کـــدام اپشن نبوده این قانون بین الملی است اگـــــرافغانــــــستان ضرورت به این قـــــانون دارد مکلف است که این قــــانون را تعقیب نمـــــایند اگر کمپنی انجو هرکه بودند درباره پول که به این کشورکمک میشد فعلاً کناره خواهد گرفت.

محکمه قاضی بختیاری محکمه نبوده بلکه یــــــــک جلسه های کانفرانس بوده است البته مطابق بـــختیاری سه شــــاهد را تست نمود  یـــک از ایشـــان قسم به صـــداقت وراستی ننموده است تنها دلیل معلومات به مردم بوده است اگـــر حقوق را پـــــاین بــــــگزارید آن یــــــــک جلسه مطبوعاتی بوده است یک جلسه محکما تی نبوده است وصفارت امریکا بخاطـــــــــــرگفتن مردم رایـــــگان وجبعه اتفاق یک نفر ترجمان را برای نیمه روز تهیه دیده است.

قاضی درتمــــام جلسات حاضر بـــــوده درآخرین ورق حکم او گفته است که تمام ما همــــرای قـــوای مقاومت کــــار ووظیفه انـــــجام دادیم. وناوقتر مـــــــا فهــــــمیدیم که قاضی مـــربوط طالبان بوده است، ظــــــــاهراً، بعضی قسمت دولت کتهگوری های قوماندانان شهید احــــــمد شاه مسعود قوای نظامی متحد (مجاهیدین جبعه متحد) میباشد مـــــانند غیر قانونی ویا بیدون شناخت وتضاد درداخل دولـــت بــــوده، در حــــقیقت ایشان در جریان جنــگ در سال 2001و 2002 منسوب به دولت امریکا بــــوده است. محکمه و دولــت حــــامد کرزی این را هم نادیده گرفته است کـــــــه جبعـه متحد مربوط به شهید احــــــــمد شاه مسعود هم در سال 2001 پارت کـــــــــــانفرانس بن بوده است (قسمیکه شناسایی شده ایشان اشخاص مــــعقول، مشروع، و برحـــــــق به دولت  بـــــوده و اشخــــــاص کــــــه تبعیده شده هستند) وپـــــــارت دولت تعین گردیده هستند کـــــه تعغیر نمی کند تا دسمبر 2004.

Inside the File- the proof of POW Status

The Court's file contains complete, in fact, irrefutable evidence that the men of TASK FORCE SABER/7 are POWs under the Geneva Conventions and accompanying protocols. However, the men have not been allowed to see the file, or to use it in their defense.  The file that Judge Bakhtyari concealed from everyone, except journalists that paid him under the table, contained pictures of TF SABER/7 in military uniforms, operating with international military forces, in meetings with top government officials, pictures of their vehicles- with Ministry of Defence license plates,[4] Lt. Zorro's and Major Amin's Afghan military ID Cards, Afghan military visas, and authorization documents from Commander Massoud's top-level Northern Alliance commanders. The Americans' US ID cards, US Passports, GC ID cards, and military authorization documents were immediately removed from evidence by the FBI and have never been seen again.  Why?  Because of Abu Ghraib.  The US government was still reeling from the Abu Ghraib pictures in July 2004, and were not about to be dragged into another abuse scandal.  The Americans and Afghans fighting the terrorists, were convicted by a Taliban Judge and a Taliban Prosecutor before the first day of trial ever began.  In fact, no witnesses ever testified against the defendants, nor was the defense allowed to call witnesses.[5]

All Afghan Combatants, including those that escaped and were not captured, were serving officers, commissioned ranks, in the United Front Military Forces (a.k.a. Northern Alliance) and the Afghan Ministry of Defence (previously the Northern Alliance.)

Most recently, on February 7th, 2005, the Afghan Court of Appeals, over great objections by BOTH governments (US & Karzai) cleared the men of ALL torture charges in a secret hearing where secret undercover video and audio evidence was played for the court.

The Geneva Convention is very clear on this issue.  Section III Article 72 specifically outlines and mandates the "Right of Defence"  ß II, which states "Accused person shall, unless they freely waive such assistance, be aided by an interpreter, both during preliminary investigation and during the hearing in court.  They shall have the right at any time to object to the interpreter and to ask for his replacement.

Taliban Judge Abdul Baset Bakhtyari repeatedly violated this rule over and over, in full view of the press and even laughed about it on numerous occasions, yet not one journalist reported this-- a few journalists reported that sometimes "there were 'problems' with the translation."

Zorro was NOT allowed to translate for Jack during the trial.  In fact, when Zorro told Jack that the translator was incorrectly repeating Jack's words to the court and saying things the prosecution never said, Zorro was threatened by NDS officials, and later by the FBI.  Later that day, when the group returned to SADERAT, the NDS Prison, Amrullah and the FBI had Zorro thrown in wrist and leg chains for thirty days, where he remained 24/7.  When Major Ezmerai told Jack that a translator was lying and making intentional mistakes, Ezmerai was later beaten.

Specifically:

IDEMA, BENNETT, RASULI BANDERAS, EZMERAI, each claim POW status as combatant prisoners of war under the following circumstances and criteria;

1. Each were employed by the U.S. Counter-Terrorist Group;

2. Each carried their arms openly;

3. Each was responsible and subordinate to a commander.

4. The unit designation was Task Force 7, later changed to Task Force Saber/7, the unit, under the original name of Task Force Saber operated in Afghanistan against Taliban and al-Qaida forces since the start of hostilities in October 2001, and was from the start of the war until present time, subordinate to both, a commander in the United States and/or to the corps commanders of the United Front Military Forces in Afghanistan.

5. Each man wore a distinctive uniform and recognizable insignia;

   1. An American Defense Logistics Agency issue uniform;

   2. An American flag on the left breast and right shoulder [Lt Banderas & Major Amin also wore Afghan flags];

   3. Uniform standardized combat equipment (i.e., LBE, boots, etc.);

   4. A distinctive emblem on all aircraft and vehicles used in military operation (i.e., A/C N.A. symbol – vehicles American and N.A. flag);

   5. A distinctive I.D. card worn on military operations.

6. Each man operated according to the laws and customs of war and abided by the Geneva Convention;

7. Each man carried a Geneva Convention identity card with name, rank, duty, position, identity number, and organization.

Note: See Articles 13(2), 13(3), 13(4) of the Geneva Convention entered into force 21 October 1950.  The Combatant version is not available, but states similar or the same criteria.  [US Embassy Consul Sandra Ingram refused to provide copies of the Convention to the prisoners in direct violation of International Law.]

Excerpt- Paragraph #1 from the Geneva POW Status Request From the Original TF SABER/7 Letter:

The judge presiding over the various trials conducted announced during his final verdict that we were all part of or working for the “resistance forces.”  [It was later disclosed that this Judge was a former Member of the Taliban].  Apparently, some parts of the government, have now categorized Commander Ahmad Shah Massoud’s United Military Forces (the Northern Alliance Mujahadeen) as illegal and/or unrecognized, and in opposition to the Interim Government, in spite of the fact that they were U.S. allies during the 2001–2004 war.[6]    The Court, and Karzai Government has also ignored the fact that Commander Massoud’s Northern Alliance were part of the 2001 Bonn Conference (which recognized them as the legitimate government in exile) and were made part of the Interim Government, which will not change until December 2004.

Readers Note: How does a Taliban Judge end up presiding over the trial of Anti-Taliban Forces, specifically American citizens and Northern Alliance military officers?

A.  Prisoners of war, in the sense of the present Convention, are persons belonging to one of the following categories, who have fallen into the power of the enemy:

1. Members of the armed forces of the armed forces of a Party to the conflict as well as members of militias or volunteer corps forming part of such armed forces.
2. Members [This and #1 apply to Jack, Bennett, and the other Americans not originally captured/arrested by Karzai's Pro-Taliban government] of other militias and members of other volunteer corps, including those of organized resistance movements, belong to a Party to the conflict and operation in or outside their own territory, even if this territory is occupied, provided that such militias or volunteer corps, including such organized resistance movement fulfill the following conditions:
   1. that of being commanded by a person responsible for his subordinates;
   2. that of having a fixed distinctive sign recognizable at a distance;
   3. that of carrying arms openly;
   4. that of conducting their operations in accordance with the laws and customs of war.
3. Members of regular armed forces who profess allegiance to a government or an authority not recognized by the detaining power [Major Amin, Lt. Banderas- UFMF] [Northern Alliance].
4. Persons who accompany the armed forces without actually being members thereof, such as civilian members of military aircraft crews, war correspondents [Caraballo], supply contractors... [ ] provided that they  have received authorization from the armed forces which they accompany, who shall provide them for that purpose with an identity card similar to the annexed model.
