Jack Idema is from Poughkeepsie, New York.  His mother was a secretary at the Pentagon during World War II.  His father was a United States Marine who rose from private to Master Gunnery Sergeant, First Sergeant, and Sergeant Major in three short years, fighting on Iwo Jima (5th wave), Okinawa, Guam, and entering Japan only days after the surrender with the 3rd Marine Division.  John Idema had been training to assault the cliffs on the coast of Japan, he estimates that 100% of the first raiding force would have been killed.  At 84 years old John Idema still holds a commercial pilots license and has recently been diagnosed with Hodgkin's disease, meaning the likelihood of ever seeing his son again is slim to none.  Jack's entire family has served in America's Armed Forces with distinction, his uncles in the Pacific, Europe, Normandy, and against all enemies. 
At 12 years old Jack decided to forgo Veterinarian or Law School and join the Green Berets.  It was the height of the Vietnam War.  At 18 he became the youngest Green Beret in American history.

For more than 27 years Jack Idema has defended his country in Latin America, South America, Eastern Europe, Africa, the Mid-East, South East Asia, Central America, and finally, South West Asia.  For more than a quarter of a century Jack has worked in counter-terrorists projects and  activities which may never be known or written about but which have kept America and its allies free from oppressors and terrorists. 

During the 2002 war in Afghanistan, his mother died.  Jack was chasing Iraqi, Pakistani, Iranian, and Japanese al-Qaida terrorists in Afghanistan.  He had been very close to bin Laden, and this was well documented by UPI, books, and other news sources.  He did not return to bury his mother until three weeks later.  Wounded twice, with nine straight months in combat and/or intelligence operations, Jack Idema served continuously longer than ANY other ground operator in Afghanistan in 2001/2002.  When al-Qaida again threatened regional security and the lives of his Afghan friends, Jack returned on what was to be a 30-45 day operation against a single terrorist bomber.  Almost one year later, he and his men remain the only American Prisoners of War in the World.

The TIGER ROARS:

"After graduating Phase I, and being awarded the coveted Green Beret, Jack had many more courses and schools to attend.  Jack learned everything the top instructors in Special Forces had to teach.  Mike Echanis, the infamous hand-to-hand-combat specialist, pronounced the five-foot-nine-inch tall youthful fighting man an adept Hwa-Rang-Do warrior after another three months of training with the instructor, again thanks to Jack’s mentor, Beckwith.  Beckwith also arranged for the young special warfare student to receive cross-training in other areas before being assigned to regular Special Forces duties. 

Over the years, Jack would become an extremely controversial figure in Special Forces.  A quarter of a century later, CBS’ Dan Rather would voice his own opinion of Jack when he met him in Afghanistan, saying he was  “politically incorrect, abrasive, unconventional, and unquestionably heroic.”   Jack had missed Vietnam by the time his Special Forces training ended, but he wasn’t about to miss Afghanistan and a crack at bin Laden, even if he was officially out of the Army.

On September 12, he told his friends he was going to war and two weeks later he was packing to leave for Afghanistan—like the rest of the Green Berets, he meant just what he said."

TORA BORA:

"In the chaos, the highest bidder could easily buy the different opposing commanders and clans, purchasing their loyalty or silence, which allowed the al-Qaida and Taliban to move freely in the region.  Thirdly, the AQ and Taliban were fleeing and moving across their own turf, within their established networks, especially in the southeast where they had always been strong.  Human intelligence (HUMINT) from prisoners, turncoats and walk-ins while valuable, was slow in coming, and unlikely to help in the immediate pursuit.  The lack of HUMINT was the single critical factor in the way.  Northern Alliance Afghans knew that the AQ and Taliban could not be trusted, and everything had a price on it, even the smallest detail.  More importantly, HUMINT could only be developed by small teams, or one man, on the ground and deep inside the Afghan community, and the US was not prepared to risk lives that boldly, nor were they ready to allow a single man to wade into such incredible danger.  What they needed was individual men, or a man, with the Northern Alliance, twenty-four hours a day.  There was one such Green Beret operator, and his name was Jack.  But he wasn’t working for Rumsfeld or Tenet, although he was helping them as much as he could behind the scenes.  The CIA was relying more on Predator UAVs than people on the ground, and the Tora Bora showdown was escalating faster and with a wider scope than anyone initially expected."

By the end of January 2002, Tora Bora, which had previously been inundated with press and U.S. military forces, was now a ghost town."

From THE HUNT FROM BIN LADEN Confirmed by UPI News (2/9/02):

"On February 5, Jack, an American advisor working with the Northern Alliance, targeted Osama bin Laden just south of Tora Bora in the Dehbala region.  He had been working with secret intelligence assets in the mountains for two months to locate bin Laden.  The group in hiding was positively confirmed be extremely high-ranking AQ commanders.  There was also a very good chance bin Laden himself was with them, and receiving constant medical care for his kidney problems, and a shrapnel wound received in Tora Bora.  On February 6, 2002, just as Jack was organizing his force to attack, a CIA Predator UAV flew high over the mountain area.  The remote operator zoomed in the camera and locked on to the small group of men.   He quickly spotted what Jack already knew.  There was a tall man in the group who was surrounded by bodyguards.

Banking the Predator to the right, it came over the barren terrain and fired its single Hellfire missile at part of the suspected group.  The Hellfire rocket sliced through the thin air and impacted within meters of the running men.  Most escaped death and the terrorists scattered and ran before the American advisor and his muj troops could assemble and close in on them.

The operations, both Jack’s and Agency’s would be clouded in secrecy and questions would always remain as to the identity of the men on that mountaintop.

As the Afghan troops and their Special Forces partners searched the villages, they found twenty-five bodies during the initial search."

From Chapter 23 -
OPERATION ANACONDA
and Confirmed by UPI, ABC, CNN, and Italia TV News Reports:

"Jack, an advisor to the Northern Alliance, was with Gulhaider’s troops, having been sent by General Gada in Kabul.  Gada was the oldest of the Mujahadeen commanders, and had it not been for his age, he probably would have been the defense minister.  Fahim, now Defense Minster and overall commander of all Afghan forces, still consulted Gada on a regular basis, and kept him as one of his closest confidantes. 

With Jack on site, the Northern Alliance knew they would have a voice, and support in both the intelligence and medical arenas.  Over the next days Jack operated on more than two dozen Afghan troops, often removing AQ bullets from wounded muj in the middle of the desert villages, or on rocky hilltops.  The muj would stand around in awe watching him operate and stitch their wounds in the middle of nowhere.  It was a familiar scene to the Green Berets, who had used this sort of medical assistance before in Vietnam to build bonds with the Hmong, Montagnard, and other tribes fighting the Viet Cong with them.  Without fail, after each round of medical assistance, the local Pashtuns also watching would voluntarily provide him with al-Qaida intelligence."

The Geneva Convention Books about the laws and rules that certain bloggers say do not exist.

The press have called TASK FORCE SABER 7 personnel "mercenaries."  One headline from the NY Times (ala Jason Blair hype) is in some of our banners saying "Mercenaries in Afghan Case Get 8 to 10 years."  It is clear that these men are not, nor ever were mercenaries. See: GC Protocols Article 47.  The TF SABER/7 Geneva Convention Legal Brief/Letter clearly forecloses any argument to even consider they are or were "mercenaries." 

It is undisputable that all seven of the defendants had Geneva Convention POW status.  POW status is established by simply asserting the status upon capture or arrest in a conflict area.  At that point you have POW status.[1]  After that, it is up to the high contracting party (one of the countries that is a party to the conflict) to either accept or deny status.  However, status continues until such time as a Geneva Military Tribunal meets and either awards permanent status, or rejects status.  But, and this is an important but, from the moment of assertion, a person "in custody" or "confinement" has automatic status the moment they assert that status, either verbally or in writing.[2]   TASK FORCE SABER 7 personnel did that very quickly, and followed it up in writing.

Within 24 hours they asserted their Geneva Convention Status, within 30 days they asserted status in writing, and 60 days later they filed a complete legal grounds brief with the Central Information Bureaux in Switzerland, and copied the Red Cross- the guardians of the Geneva Convention.[3]

I am a Green Beret, not a candy striper, or a wannabe, or some fake drunk at a bar claiming all his missions were classified and he has to kill you if he talks about it.  I've come close to killing bin Laden twice, and found him five times, and that makes me better at this than the FBI, and a lot of other people.  This is why the FBI hates me, and my guys, because they are the Federal Bureau of Investigation and we are a storm of interdiction.  We stop the bastards before they kill more Americans we don't show up afterwards with blue windbreakers and forensic squads hoping to identify the bodies.  I get close to bin Laden because I live and work with the Northern Alliance Afghans and I'm not afraid to ride straight into hell with a few guys and a lot of bullets.  And this isn't bullshit, and I've got the pictures and evidence to prove it, so one day you will be seeing that too.

You can't fight terrorists with law enforcement and prosecution, Clinton tried that for eight years.  You can't do it, they are animals they are not human, just ask the families that lost their loved ones on 9/11.  When the terrorists capture us they cut off our heads on television.  When we capture them they complain that we don't let them piss for twelve hours.  Well, sorry about that motherfucker, you were about to drive explosive rigged gas tankers into Bagram and kill 500 American soldiers in a ball of flames.  You should be glad I didn't defenestrate you.  I believe that real Americans want real counter-terrorist operations, not bullshit press junkets and canned PR stories from PAOs that shot a gun once in their life on the basic training qualification range.  I didn't start this fucking war, not the one with bin laden, nor the one with the press, they started it, but I will finish it, or die in the process.

This page really ought to be called Jack Fights Back.  After nine months of vitriolic (our favorite word now) lies by the press and these jerk-offs at Flogging the Simian, after attacks on our families by the press and the FBI, after repeated physical attacks on us by Taliban and al-Qaida terrorists trying to collect Bin Laden’s reward on me, and after attacks by every two-bit conman fraud "author" and "journalist" trying to make a buck off our story and our misery, I am finally speaking out.  Not through some fleabag wannabe journalist, but through this website with my own words.  Last month I was lucky enough to get a chance to speak directly to the public for the first time, on a live radio show in Fayetteville, North Carolina, home of the 82nd Airborne Division and the US Army Special Forces, along with most of the other Special Ops units I have been part of or affiliated with, or had the honor of working with over the past 30 years.

Tora Bora December 2001 painting tanks for an assault on the TalibanThe show was hosted by Chris Chaos and his partner Lindsey.  I can’t thank them enough for the opportunity to speak for myself, unfiltered, unfettered, unabridged, and most of all, un-spun.  It was the ONLY time I have ever agreed to a taped or on-camera interview (other than our in-court statements during two trial hearings).  Dozens of "journalists" have asked, written, and shown up at Pulacharke Prison with cameras only to be sent away by us.  I did this one interview because it is my home, and because of the recent attacks on my wife.   She was arrested in her pajamas by the US Marshals, at the behest of the FBI, on a phony warrant (and released hours later with a pitiful apology).  She has been threatened and interrogated by the FBI (seems they are working more for Osama bin Laden than against him) and she has been assaulted, threatened, and harassed by a variety of press, pseudo-press, and private parties.  She has been stalked, had sugar put in her gas tank, assaulted in the dead of night, and been slandered to inth degree by the scumbags at Flogging (they also threatened her in writing), and so many other make believe “journalists.”  No one has gotten her story right, my story right, our story right, or any story related to this right.  Most have outright lied intentionally.

PPS: May 10, 2005- I guess Khalilzad read our website, because the bastard arranged for the release of hundreds of terrorists this week.  Two America's most wanted terrorists were granted amnesty today (Hekmatyar and Mullah Omar) and the Taliban Minister of Foreign Affairs is now walking around Kabul free after having killed tens of thousands.  Meanwhile, no one remembers all the Green Berets that died here over the last three years.  So, the terrorists we all captured in 2001 did just two years in jail, and Caraballo gets that much time for taking a picture of me (that's all he was EVER accused of- taking pictures) arresting Bin Laden's adopted son-in-law.  This is some twisted world and our government is more fucked up than I originally thought.

Some Background Information about the SuperPatriots and Task Force Commander Jack:

Prisoner Of War status has become a hot issue in the War On Terror. The legal grounds to deny POW and Geneva Convention status to al-Qaida, Iraqi, and Taliban terrorists is simple-- they don't meet the requirements of Rule 4 of the Geneva Convention for Combatant Prisoners.  Few terrorists do.  To see these rules, follow this footnote: READ RULE 4.

Terrorists don't wear uniforms, have ID Cards, carry their weapons openly, wear unit patches (what would it say? AQ Killer Group with twin burning towers as a logo?), nor do they follow any of the other guidelines required by Rule 4, except that they might be subordinate to a commander (like bin Laden, Hekmatyar, Mullah Omar, etc).   But being subordinate to a madman does give rise to GC protections, you must follow all of the requirements of Rule 4.

Some people say that one man's terrorist is another man's freedom fighter.  Cute saying, but not legally correct.  Freedom fighters and guerillas, historically, wear uniforms- no matter how ragged or mismatched, they carry their arms openly, rarely target civilian women and children, have military ranks and often have Identity Cards. Some examples include; Tito's resistance in WWII, Cuba- 1950's, Dominican Republic- 1960's, Nicaraguan Sandinistas- 1970's, the US backed Contras and the US opposed Salvadoran FMLN- 1980's, Karen Rebels-1990's, and Commander Massoud's Northern Alliance 1996-2004. And, especially, Commander Massoud's Mujahadeen resistance fighting the Soviets throughout the 80's.

تمـــــــام افغان ها مبارزه نموده است حتــــــا آن اشخاص کـــــه دستگیر نشدند وگریختن تمــــام افسرهــــای برای خدمت هستند هرکدام آنها رتبه های عالی در نزد جبعه متحــــــد دارند که در وزارت دفاع قبلی وظیفه انجام میدادند.

اخیراً درفبـــــروری 7/2005 درمحکمه استنـــاف افغانستــان یـک اعتراض بزرگ که توسط هردوکشور بود امــــــــــریکا و افغانستان که دریـــــک دادرسی کــــوچک البته اسناد های ارایه گــردید که التبه تصویری وغیر تصویری بود که از تروستان بوده که بیان نموده است که هیچ کسی ایشــــان را شکنجه ننموده است.
 


قــــــانون جینواکانوینشن خیلی واضع گفته است دربخش سوم ودرماده 72  که البته دربــــاره حق دفاعی بوده است وگفته که هرمتهم حـــــق دارد کـــــــه از ترجمـــــــــانان ومنحیث معاون استفاده  درجریان تحقیقـــــــات دادرسی ها وجلسات محـــــکمه کمـــک بخواهد واین حق را هم دارند کـــــــه بخاطــــــر تبدیلی ترجمانان اعتراض به تبدیلی آن کنند.

عبدالباسط بختیاری طالب کـــه دایماً این قاعده هـارا مشکستاند وخـــلاف ازقانون مینمود وهیچ جـــــورنالیست بطـــور درست راپورنداده است لیــــکن بعضی گفته است که ایشان مشکل در ترجمـــانی دارند.

برای زرو اجازه نداده بودند که برای جــــــک ترجمانی کند در جــــــــریان جلسات محکمه در حقیقت زرو به جک گفت کــــه ترجمه مکمل غلط بوده وچیزی که سارنوال نگفته است اوتکراراً ازدلخود ترجمه نموده است وقتیکه زرو کوشید کــــــه ترجمه نماید وقتیکه درصدارت وامنیت ملــــــی برگشت نمودند ازطرف امینت ملی واف بی آی برای 30 روز زولانه گــــردیده است البته ازطــــــــرف امراله در24/7 میباشد.

ترجمانان قاعده های بین الملی را پامــــــال نـــموده است این اشخاص بخاطـــــــر احترام در قانون جینواکانوینشن که بخاطر بندی های جنگی میباشد وقاضی عبدالباسط بختیاری که تخلــــف ونادیده گرفته است قــــانون بین الملـــــــی را وتوسط این دولت قـــانون بین الملـی امضا گردیده است دردسمــــــــبر 10/1948 درزیرنظر یــــــک جنرال ملل متحد اسمبلی ریسه لوشن 217 بخش سوم که بطور آشکار این قانون را خلاف نموده است این کـــدام اپشن نبوده این قانون بین الملی است اگـــــرافغانــــــستان ضرورت به این قـــــانون دارد مکلف است که این قــــانون را تعقیب نمـــــایند اگر کمپنی انجو هرکه بودند درباره پول که به این کشورکمک میشد فعلاً کناره خواهد گرفت.

محکمه قاضی بختیاری محکمه نبوده بلکه یــــــــک جلسه های کانفرانس بوده است البته مطابق بـــختیاری سه شــــاهد را تست نمود  یـــک از ایشـــان قسم به صـــداقت وراستی ننموده است تنها دلیل معلومات به مردم بوده است اگـــر حقوق را پـــــاین بــــــگزارید آن یــــــــک جلسه مطبوعاتی بوده است یک جلسه محکما تی نبوده است وصفارت امریکا بخاطـــــــــــرگفتن مردم رایـــــگان وجبعه اتفاق یک نفر ترجمان را برای نیمه روز تهیه دیده است.

Inside the File- the proof of POW Status

The Court's file contains complete evidence that the men of TASK FORCE SABER/7 are POWs under the Geneva Conventions and the  accompanying protocols. However, the men were  never allowed to see the file, or to use it in their defense.  The file that Judge Bakhtyari concealed from everyone, except journalists that paid him under the table, contained pictures of TF SABER/7 in military uniforms, operating with international military forces, in meetings with top government officials, pictures of their vehicles- with Ministry of Defence license plates,[4] Lt. Zorro's and Major Amin's Afghan military ID Cards, Afghan military visas, and authorization documents from Commander Massoud's top-level Northern Alliance commanders and Karzai's Corps Commanders. The Americans' US ID cards, US Passports, GC ID cards, and military authorization documents were immediately removed from evidence by the FBI and have never been seen again.  Why?  Because of Abu Ghraib.  The US government was still reeling from the Abu Ghraib pictures in July 2004, and were not about to be dragged into another abuse scandal.  The Americans and Afghans fighting the terrorists, were convicted by a Taliban Judge and a Taliban Prosecutor before the first day of trial ever began.  In fact, no witnesses ever testified against the defendants, nor was the defense allowed to call witnesses.[5]

All Afghan Combatants, including those that escaped and were not captured, were serving officers, commissioned ranks, in the United Front Military Forces (a.k.a. Northern Alliance) and the Afghan Ministry of Defence (previously the Northern Alliance.)

Most recently, on February 7th, 2005, the Afghan Court of Appeals, over great objections by BOTH governments (US & Karzai) cleared the men of ALL torture charges in a secret hearing where secret undercover video and audio evidence was played for the court.

The Geneva Convention is very clear on this issue.  Section III Article 72 specifically outlines and mandates the "Right of Defence"  II, which states "Accused person shall, unless they freely waive such assistance, be aided by an interpreter, both during preliminary investigation and during the hearing in court.  They shall have the right at any time to object to the interpreter and to ask for his replacement.

Taliban Judge Abdul Baset Bakhtyari repeatedly violated this rule over and over, in full view of the press and even laughed about it on numerous occasions, yet not one journalist reported this-- a few journalists reported that sometimes "there were 'problems' with the translation."

Lt. "Zorro" Banderas  was NOT allowed to translate for Jack during the trial.  In fact, when Zorro told Jack that the translator was incorrectly repeating Jack's words to the court and saying things the prosecution never said, Zorro was threatened by NDS officials, and later by the FBI.  Later that day, when the group returned to SADERAT, the NDS Prison, Amrullah and the FBI had Zorro thrown in wrist and leg chains for thirty days, where he remained 24/7.

If you get right down to it, the trial was a press conference, not a trial.  Bakhtyari's Court basically held a press conference, because the three terrorists that did "testify" were not sworn in, and according Bakhtyari, were for "public information purposes only."  The Embassy, under pressure from the Northern Alliance, finally provided an interpreter for one half day.[6] 

The translator requirements, are also rules of international law, required in the trial of ANY foreign national, regardless of GC POW status.  Bakhtyari's violations of this international law, signed by the government of Afghanistan and adopted into law on December 10, 1948 under UN General Assembly Resolution 217 A (III) are patently egregious.  They are not an option, they are international law.  Over the recent months, Taliban officials, now back in the Karzai government, have been arresting Americans and even detaining American Department of Defense personnel entering the country through Kabul on Official Orders.  The tide is quickly changing against America in Afghanistan.  Any company, NGO, or individual considering investing money in Afghanistan ought to be thinking twice and DOD contractors should be getting guarantees from the US government in writing as to their safety against false charges and Taliban run trials.

The unit designation was Task Force 7, later changed to Task Force Saber/7, the unit, under the original name of Task Force Saber operated in Afghanistan against Taliban and al-Qaida forces since the start of hostilities in October 2001, and was from the start of the war until present time, subordinate to both, a commander in the United States and/or to the corps commanders of the United Front Military Forces in Afghanistan.

  5. Each man wore a distinctive uniform and recognizable insignia;

    1. An American Defense Logistics Agency issue uniform;

    2. An American flag on the left breast and right shoulder [Lt Banderas & Major Amin also wore Afghan flags];

    3. Uniform standardized combat equipment (i.e., LBE, boots, etc.);

    4. A distinctive emblem on all aircraft and vehicles used in military operation (i.e., A/C N.A. symbol – vehicles American and N.A. flag);

    5. A distinctive I.D. card worn on military operations.

  6. Each man operated according to the laws and customs of war and abided by the Geneva Convention;

  7. Each man carried a Geneva Convention identity card with name, rank, duty, position, identity number, and organization.

Note: See Articles 13(2), 13(3), 13(4) of the Geneva Convention entered into force 21 October 1950.  The Combatant version is not available, but states similar or the same criteria.  [US Embassy Consul Sandra Ingram refused to provide copies of the Convention to the prisoners in direct violation of International Law.]

Excerpt Below- Paragraph #1 from the Geneva POW Status Request From the Original TF SABER/7 Letter:

The judge presiding over the various trials conducted announced during his final verdict that we were all part of or working for the “resistance forces.”  [It was later disclosed that this Judge was a Member of the Taliban].  Apparently, some parts of the government, have now categorized Commander Ahmad Shah Massoud’s United Military Forces (the Northern Alliance Mujahadeen) as illegal and/or unrecognized, and in opposition to the Interim Government, in spite of the fact that they were U.S. allies during the 2001–2004 war.[7]  The Court, and Karzai Government has also ignored the fact that Commander Massoud’s Northern Alliance were part of the 2001 Bonn Conference (which recognized them as the legitimate government in exile) and were made part of the Interim Government, which would not change until December 2004.

Readers Note: The Combatant version was not available to the men when they wrote their status request, but they were correct, the Geneva Convention Relative To The Treatment Of Prisoners Of War of August 12, 1949, Part I, Article 4, states:

A.  Prisoners of war, in the sense of the present Convention, are persons belonging to one of the following categories, who have fallen into the power of the enemy:

  1. Members of the armed forces of the armed forces of a Party to the conflict as well as members of militias or volunteer corps forming part of such armed forces.
  2. Members [This and #1 apply to Jack, Bennett, and the other Americans not originally captured/arrested by Karzai's Pro-Taliban government] of other militias and members of other volunteer corps, including those of organized resistance movements, belong to a Party to the conflict and operation in or outside their own territory, even if this territory is occupied, provided that such militias or volunteer corps, including such organized resistance movement fulfill the following conditions:
    1. that of being commanded by a person responsible for his subordinates;
    2. that of having a fixed distinctive sign recognizable at a distance;
    3. that of carrying arms openly;

POW Historical Information


[UFMF- Northern Alliance] The Lion of the Panshir
The United Front Military Forces, more commonly known as the Northern Alliance.  The N.A. was commanded by Commander Ahmad Shah Massoud, under the political leadership of President Rabanni.  This was acknowledged as the rightful and legal government during the time of the Taliban, and operated in exile, holding out in North Eastern Afghanistan and maintaining control of roughly 15% of the country.  The NA maintained Embassies in Washington, Dushanbe, Tashkent, Delhi, and London, among other places.  The NA was fully recognized by the United Nations and the United States as a legitimate government and resistance force against the Soviets, and later the Taliban.  Therefore, because all Task Force Saber/7 members were officially attached to the NA, and Major Amin and Lt. Banderas were commissioned serving officers in the NA, it is clear that they have full POW status.

[1]   Jack, on behalf of all subordinates, asserted POW protected status under the Geneva Convention of 1949 on the second day of capture, and no defendant has ever waived protected status since that time.

[4]  That evidence showed that defendants were driving government issued SUVs at the time of the arrest with Ministry of Defense official license plates.

Fighting Jack[5]  1.    Only ONE witness testified under oath at the Primary Court Trial- Jack, who refused to speak unless sworn in on the Koran and placed under oath.
      2.    Only 5 people testified during the second trial, ALL defense witnesses demanded to be sworn in.  ALL of the prosecution witnesses refused to testify under oath.
      3.    Not one prosecution witness has ever testified in either trial.  The 3 prosecution witnesses that spoke in the first trial DID NOT TESTIFY.  They were not sworn under oath and the Court (Judge Bakhtyari) announced the three (3) people were only providing background facts for the press.  No questions were allowed.  No cross-examination, and no confrontations were allowed in direct violation of law.  Therefore, it was a press conference, not a trial.
      4.   The first time witnesses were actually forced to testify under oath in private hearings at the appeal court's trial de novo (December 7, 2004) it resulted in the release of 4 people.  All four refused to leave without the three Americans.  Jack ordered them to leave.  After a lengthy discussion with the court, three men were released, including Major Ezmerai Amin.  Lieutenant Banderas still refused to leave the Americans at Pulacharke.  Finally, Judge Abed and Jack agreed that Zorro could stay with the group until the new trial was concluded.  When asked why by Rolling Stone Magazine, Lt. Banderas stated, "If there is one main point I have learned from American Special Forces, it is that no man will be left behind."

Russel Brown - The US Consul[6]   This interpreter was fired by Bakhtyari.  Another interpreter was finally provided by the US Embassy, and only worked for two hours, and was also fired by Bakhtyari.  But the US Consul KNEW the translation was incorrect and did nothing to stop it, contrary to US State Department policy.

The Northern Alliance- Forgotten US Allies[7]  The United Front Military Forces aka Northern Alliance is more specifically outlined in the historical information footnote above along with their legal status and relationships regarding the Geneva Convention. Bakhtyari's categorization of the NA as a Resistance Force (of course it was a "Resistance Force" - in the resistance AGAINST the Taliban) makes it clear that Bakhtyari was looking at this case from a Taliban point of view.  Further, it provides evidence and support for permanent G.C. POW status to all members of Task Force Saber/7.
